HI

I have my own buisness and last year i worked most of the year for a department store as a designer. the previous year i unfortunately forgot to file a tax return. is this a problem.. my accountant is working on 2006 returns any help would be much appreciated.

Thats more of a question for the MENA forums as each country has diffrent requirements. Some require 1 year, others 3. While some are happy with just a letter from your employer.

I believe USCIS calls for one years tax return if you are an employee and three years if you are self employed.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.
Waiting - Waiting - Waiting
3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

I remember it being 3 yrs tax return for employee, atleast the instructions told me that

Self employed people are required to submit the three most recent tax returns. Employed people are not required to submit more than 1 but 3 is a good idea if it will help your case.

USCIS requirements for Affidavit of Support do not come into play until after the visa is issued and AOS is applied for. For now, the sponsor is only satisfying the public charge concern for the Consulate. Those requirements tend to vary by country.

I have been reading this and tried to look to see what Germany required, but I noticed on the Affidavit it says 3 years for a self employed person. It is a bit confussing, they seem to change things just slightly, 100% at consulate, and then 125% of poverty line at AOS. One year of tax returns, three years....

Are you talking about K-1 or AOS? For K-1, the requirements I see are on the I-134, and it just says this:

C. If self-employed:

1. Copy of last income tax return filed; or

2. Report of commercial rating concern.

The instructions for the I-134 do not ask for tax returns, (unless you are self employed). I did not submit any and none were ever asked for. Your consulate may have instructions or requirements in addition to the I-134 instructions, but my advice is, dont give them ####### they dont ask for.

The OP is self employed. I checked again and the form does ask for only one tax return from self employed people. The Consular officer is free to ask for whatever they desire to see, however. So many Consulates' guidelines are to ask for three. If you have them and they help your case, it's a good idea to provide them.
