Greetings to everybody

 

Long story short... I came from Switzerland for a women.. Visa got approved and I moved from switzerland to the USA in May 19.. I love her... I still do... but I don't feel like she loves me the same anymore.. Before you bomb me with greencard (removed).. like I said.. I am from Switzerland.. made over 85k CHF (more or less same as in the U.S) per year.. supported her since July 18 with 1'500/month (and still support her since May 19 with now 2k from my retirement swiss money) so she did not lose the house for her/us/ and her kids she has.

I literally screw up my life in Switzerland for her, made debts to support her...

 

So my question is.. if I can't take it anymore.. or she can't take me anymore.. what are my options?

I know she signed a paper that says that she is responsible for me for 10 years in the U.S...

 

But what are my options when (removed) hits the fan?

I feel slowly like I have to protect myself and to inform me.. won't give up asap.... but I want to be prepared.

I want to build up my life in the U.S again.. with her or without... sure rather with her... 

Please don't get a wrong picture of me..  just as example: I sent her flowers like monthly from Switzerland  to her home or to her office for anniversary's .. still do it between even when money is short.. but she rather plays the game on her phone were we met,than be happy to spend time together without the phone.

Have the two of you filed for aos yet?  You have to adjust with the one who brought you here.   

Has the AOS been approved? If so then yes she is on the hook for you forever, unless you have 40 quarter of SSA paid or you become a citizen.

Do you have a green card yet? If so, then divorce and move on. You can do ROC on your own.

If you don't have a green card yet (AOS has not yet been approved), then start planning to be required to leave. You have no legal means to remain without her support.

If she does still want to provide support, it is technically possible to finish AOS per Matter of Sesay. Get professional assistance.

Then you're golden. Your status is not tied to your spouse.

 

If you end of divorcing (I suggest marriage counseling first!), you can file for ROC (I-751) with a divorce waiver + the final divorce decree. You only need to show that the marriage was entered into in good faith. Many people do it...don't think that being divorced is a significant hurdle.

 

FYI - You can get an unrestricted SS card now that you have a green card. I suggest going to the SSA and doing so. It comes in handy if you ever need to change jobs and your green card is expired (ROC is taking along time right now).

Divorce her, don't look back.

 

You can file for ROC right away after getting the divorce.  You get a waiver.

yeah.. but my first concern is.. what do I do when we fight and she kicks me out or calls the cops on me? I never slapped, spanked or got violent against her... but yeah.. on paper I own nothing but our common banc account at PNC.

tonight I will spend my first night on the floor... can't take it...

I am IT.. so I have skills for Notebooks and Tablets.. but for the rest I suck.. lol

Divorce is my last option... I am really just checking for options when she kicks me out.. sorry when I did not say clearly

...especially financially.. where to sleep or live for the moment

like I said.. I more need options/ideas when ***** hits the fan..

I want to work this out.. I am sure not always an angel.

And it's not all bad... but fights are getting more and more really nasty

Check with local churches, shelters, that sort of thing...if that were to happen.

Immigration wise, though, your questions have been answered appropriately---she cannot do anything like "get you deported" or anything like that.

 

You can also ask family/friends from back home to lend you money.

If you're worried about her calling the cops on you, then it's probably best to not be alone with her.

 

What is the plan for ROC if you stay married? It's the same except with a divorce decree if you divorce. You lived together - show evidence of that. You shared an account together - show that the account is used for joint expenses. You may or may not have utilities in each other's name. Show that. You may or may not have each other as beneficiaries on insurances or retirement plans. Show that. You probably went places together. Show that. They aren't concerned about joint ownership of items - they want to see that they are being used jointly, like most married couples.

She can't "kick you out". You live there. idk who owns what, but you can't just kick a resident out. You either have to leave voluntarily, be removed by law enforcement (i.e. in the event of abuse), or be evicted.

On a practical level, living with somebody who doesn't want you there is not a great idea unless there are no other options). If you're worried about being kicked out then reach out to local shelters, churches, etc.

 

As for any form of financial support or similar, that would be a question to raise with a divorce attorney.

The I-864 remains intact, but I wouldn't go down the road of enforcing it until other options have been exhausted.
