Hello everyone, thanks for taking the time to read our story and our questions.

Looks to me that we dont have a way out to solve our problem.. I came to this country as a tourist, my husband is an american citizen, we got married last year in Vegas :D .. there shouldn't be much complication, but, there is...we are both 19, and he doesn't know anybody in the US since he has lived all his life in Peru and just recently moved back to Los Angeles after 14 years to attend college, meaning he does not work and does not know anybody here to be able to help us with this process...

We need to have an Affidavit of Support, since he does not work nor has any other type of income (besides financial aid from college) he is not able to be my sponsor or we need a co-sponsor...According to what I've read online, anyone who is either an american citizen or a permanent resident who works and earns above 125% the poverty guidelines can be my sponsor... But!!!!! We just dont know anybody here... He does know some people from his own school, but most of them are international students anyways.. and the other students are full time students, so they don't work neither..

Is there a way out for us? Is there any idea ? Something helpful you might be able to share with us?

Im just worried since my tourist visa expired already 2 months ago, I dont want to sound dramatic...but, will I ever have my green card? We both would like to celebrate our first year anniversary in London, but we've been married for 7 months already...and still we dont know what to do about finding a co-sponsor. And also, Im worried because I miss my grandparents who are in Peru, they are getting older..I do really wish to see them before they get older and older ...you get my point.

honestly, it will be very hard for you to get approved for a visa if you do not have a co-sponsor. It would be wise for him to obtain a good paying jobs for a bit until you are cleared for the visa etc. you can ask one of his friends parents to co-sponsor you.

2-24-2007: Received NOA1 letter in mail (from CA)

5-21-2007: NOA2 in da mail

2-26-2007: sent 129f overnight via USPS (should get to them on 2-27-2007 by noon)

3-1-2007: Receipt date - Received by chicago center (noted on Notice I-797)

3-10-2007: Received NOA1 in the mail(Notice I797)

3-17-2007: USCIS Web site updated to notify of transfer

3-20-2007: Notice of transfer in mail

3-30-2007: Touch #1 CSC updated USCIS web site to notify me that they have my case

4-2-2007: touched (#2)

5-16-2007: touched

5-17-2007: Approved

5-21-2007: NOA2 in da mail

5-29-2007: case # assigned...

5-30-2007: Forwarded to mumbai consulate

6-1-2007:Mumbai sent out packet 3

6-13-2007: called DOS and NVC to make sure mumbai had the case. we never got the packet 3 perhaps no one was at home!?!?

6-14-2007: Wife overnights packet 3 which was downloaded from the mumbai consulate site, filled it out, and sent it in along with other documents

6-15-2007: packet 3 delivered to mumbai consulate

She doesn't need a visa. She's here already and accruing unlawful presence, which is generally forgiven when married to a US Citizen. Provided, of course, you didn't commit visa fraud.

If the OP came here with no intention of marrying but met somebody or an existing relationship matured and a marriage occured, she can legally stay and adjust status. She has accurately pinpointed the problem which is sponsorship. Since they don't HAVE a qualified sponsor, I see two options. Husband man's up and gets a job sufficient to sponsor his wife or they wait until he does so to adjust status. While they wait, she accrues unlawful presence.

Now, if she came here on a tourist visa intending to marry and stay, they have some big problems. That's visa fraud. She should hope her husband speaks Spanish or teach him because to stay together, they are likely to be living in Peru or some other country where she can legally reside.

Facts are cheap...knowing how to use them is precious...

You have already answered your own questions. As I see it, you have only three options:

  1. Find a co-sponsor! There is no alternative to that and you can't find one online either. You have to talk to your friends (their friends, their friend's friends, and so on) until you find one.
  2. Get your husband to find a job that pays at least 125% above Poverty Guidelines (I-864P). Once he finds a job (or jobs), he can sponsor you without needing a co-sponsor.
  3. Leave the US to be with your grandparents while your husband stays here, finds a job, sponsors you and then you can come back. He should consult a lawyer when he applies since you have overstayed on your visa.

Other than these three, you might want to check with a lawyer to see if he/she has any other solution for you.
