You were misinformed.......There are many here who have visited.  Even the unlikely denial of entry would not affect the petition.......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That’s why husband is the one coming to see me. Since he moved back to the states , we have traveled together twice , last August, we went home to the Philippines together and just last January 22 til feb 4 he came to see me in Israel and then we traveled to Germany before he went back to the states yesterday. That’s all we can do for now. I would love to visit my husband but I am afraid of denial so to save myself from misery, we just plan for my husband to see me instead.

When he files his 2019 tax return with the IRS, it is faster and easier if he files as "Married Filing Separately" as he can put NRA as your status.  The downside of this is most likely a smaller tax refund.

 

If he files as "Married Filing Jointly" you will need to complete a W-7 and get your passport certified in Israel by a qualifying agent:

The second option is a little more work, but will most likely result in a larger tax refund.  My husband, who was living in Brazil last year, and I did this while on vacation together in London and had his W-7 and passport certified by a Tax Acceptance Agency who came to Heathrow Airport so it was easy and only cost about $500, but the additional tax refund was much higher than if we had filed separately.

 

Either way, he needs to file as married.

Thank you for that info. My question is, do I have to do this even if I don’t have a US income and no SSN? Why do I have to be filing jointly with my husband if I am not earning US income? Can he just file for now as MFS and then when I get to the US  that’s when we will file jointly ? Is that possible?

Hi again! H&R Block are  insisting that I need to get ITIN otherwise they can’t help my husband. Then after I talk to a  US tax agent here in Israel , they have advice me that I do not need the ITIN since I have no US income . They are advising us the MFS too. Is there any alternative other than the electronic filing? The problem with the software the H&R Block using is  the blocks needs the exact and precise answer otherwise it won’t go to the next page . So my question is , is there any alternative maybe? Like a tax preparer company that do the paper filing and not electronically ? We need help please. Any idea how we will do it ? Or can you recommend a tax preparer that can help us? My husband is in Las Vegas area.

You can ask the tax preparer if they will give a paper return so it could be mailed to the IRS. Sorry but we have no experience with anyone preparing our taxes for us so I don’t know their policy on paper vs efile.  I would think they could give it to him on paper.
 

But in order to file a joint return, you must have an ITIN. You could refer the tax agent to the IRS:

Do I need an ITIN?

Does the following apply to you?

  1. You do not have an SSN and are not eligible to obtain one, and
  2. You have a requirement to furnish a federal tax identification number or file a federal tax return, and
  3. You are in one of the following categories.
  • Nonresident alien who is required to file a U.S. tax return
  • U.S. resident alien who is (based on days present in the United States) filing a U.S. tax return
  • ✔️Dependent or spouse of a U.S. citizen/resident alien 
  • Dependent or spouse of a nonresident alien visa holder
  • Nonresident alien claiming a tax treaty benefit
  • Nonresident alien student, professor or researcher filing a U.S. tax return or claiming an exception

Also there are two kinds of Agents—-Acceptance Agents (AA) and Certifying Acceptance Agents (CAA). Only a CAA can certify your passport. Be sure you talk to one of those or go to the embassy.

 

IF your get your passport certified, the W7 application, certified copy of passport, the tax return and statement must be mailed together to:

Internal Revenue Service
 ITIN Operation
 P.O. Box 149342
 Austin, TX 78714-9342

 

Your signature will be required on the W7, tax return, and statement.

 

Or husband can just file a Married Filing Separately return.
