Hey guys! Sorry I haven’t been able to respond until now - I’ve been working all day and just finally got some free time.

So yea like my fiancé has been saying... we applied for a K1 visa, everything went smooth, the interview seemed to go great and we were excited to hear that he was approved; but then we went into AP, and still until this day were still under AP. I had to reach out to the embassy to find out that his petition had been revoked and sent back to UCSIS. He then had to go pick up his passport, and was solely given his passport with no slip or anything. We also haven’t been told as to why our petition was revoked. It’s been quite messy and frustrating. I’ve been told the US administration has a lot to do with it but I’m not sure what to think?

Anyway, we've been debating on whether to re apply for the K1 visa OR the CR1 visa.

let me know what i can do here to help resolve our issue :)! Thanks for your time!

It's very important to figure out why the visa was not approved.  In most cases, marriage and a lot of time actually spent together can cure CO doubts about the sincerity of the relationship.  On the other hand, marriage will not cure other reasons for the beneficiary's inadmissibility.  Thus, first finding the real reason the visa was not issued is the best course of action.

Of course.  I was merely pointing out that the OP's fiance had been online.   I tagged this thread because it is an interesting one........

@cd37 @Altan2011 well, it’s 100% true and it’s the situation we’re in. Otherwise we wouldn’t be sitting here on a visa thread trying to get help.

I think what they mean, is that they feel there is more to the story than what has been said in terms of what may have caused the revocation, not that they don't believe that you need help. As others have already said though, you must really find out what the reason for the revocation was before you'll be able to progress with any type of visa, so that you can fix it. Is there anything that may be considered "red flags" in your relationship (few visits, large age gap, differing religions, etc)?

Our CR1 Journey:

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

October 11 2020: Arrived in US!

My not expertise opinion is that you guys will need to get married and then you can file the CR1. You will find out then if you would end up in AP what the problem is. A travel visa is gonna be next to impossible and the K1 isn’t worth the money to file again since you don’t know why your first one was rejected or whatever it was that happened.
In the meantime, spend as much time together as possible and enjoy your relationship. Living in the US shouldn’t be the goal, a life with the person you love, no matter what country it is in, needs to be what matters the most to you guys.
Reading this thread made me think all your fiancé is after is a ticket to the US, if that’s what he made me feel, a CO or the people in AP with experience in this sorta thing probably felt the same way too.

Exactly. Thank you.

SO based on all the feedback we’ve been getting back (you guys are awesome), the best thing todo first is to find out why our petition was revoked. I have reached out in the past to the consulate but they were of no help. Who can I directly contact to get help? Please drop the links/emails/phone numbers.

Thank you all!

The issue arose during AP, the only person who you can contact who has info on this is your SO.

@LilyJ @cd37 No red flags that I can think of. We’ve been honest about everything and our relationship is 100% authentic. I’m 25, he’s 24. Neither of us are religious and at that time we had met up in several countries and spent months together. Lots of pictures, receipts, hotel reservations with both our names on it, etc.. as proof. We honestly can’t think of any reason which leads me to believe that we might have been revoked due to our petition expiring.

A case in AP won't expire unless there was a request for documentation from the beneficiary that was unfulfilled.

I can tell you how expiration and  AP "works".  I can't tell you why you were denied.  Obviously no one here can and only @MachadoMercedessis going to have to do some work to find out.
