Timeline

is there a glitch or is this normal? My first noticed was 10/24/2019, and i have been checking like a crazy person for my second notice which i have not received. so this morning i checked the case status page for USCIS and it says i need to provide more information on something which i am waiting for the letter to come. but on MyUSCIS site it says i have nothing to do. has anyone experienced this? thank you in advance

You may have a RFE on the way. I see that maybe you'll be waiting a little longer till you receive your mail. Have to tried calling USICS customer service?

i just called them and the automated system says i will get the RFE. i did not speak to anyone although it is odd that one system says i will get an RFE in the mail and the MyUSCIS says nothing to do.

That's not odd at all. Many of the systems do not show they same results. To get through this jungle of a mess you just have to learn which is the one that is closes to telling the actual status or result. My guess is if it says you are getting an RFE then I would tend to believe it before the other that has no results. RFE's can be a good thing. To be in my experience most who answer the RFE are approved. So it's my bet your case and the RFE is received, and you are one of the good guys (are you wearing your "white cowboy hat" :D then you must can expect an approval. Just a hiccup in the process. You'll get it sorted out.

I just received the actual RFE, which i am going to update in my timeline to help the others, but its strange. the RFE says i need to provide intent to marry within 90 days. i wrote an intent to marry that my fiance signed and stated that she intends to marry me within 90 days. the other part stated that i need to say how we met. i admit i did not say this. we met on dating site. but i did put no broker. so two questions here. why i need to do about intent if the letter was not good enough second, me and her writing a letter stating that we met on dating site will suffice? should i also get my friends to write a letter stating the same since we both have deleted that account two years ago?

Here is what I learned a long time ago. The man with the gold gets to make the rules. So as confusing as all this may sound to most, you have to eat the elephant one bite at a times.

 

Here is what you need to do to answer your RFE.

 

1. You both need to write separate intent to marry letters. Not together but separate letters.

2. Tell a very short story of how you met. Doesn't have to be more then two paragraphs long.

3. Since you will be adding in that short story that you met on line, I recommend that you get the TOS (terms of service) from the dating service/website. You can get one either by emailing customer service and asking one to be emailed to you or you can find one from their website and download it and print it to include in your package. They are looking to see if you used a marriage broker.

4. Unless it ask for a letter from friends then I wouldn't add one to your reply. ONLY do what do will do.

 

You don't say that you have more items required from the letter so I will leave here.

thank you, do you think it will be an issue if it is a scan of the intent to marry with her signature since she lives in Ukraine? as for the terms of service i am not sure it will say my name or hers, would it?

i would hate to have to wait 2 weeks for a letter to arrive by mail,

she clearly signed the first intent to marry (i wrote it just as they have it that she intends to marry me within 90 days of arriving) and the RFE says other evidence maybe wedding plans but we plan on going to the justice of the peace since would knows when exactly they will allow her to come. waste of time and money if i made it and then we missed our date. also they said that i can show communication regarding this so i intend to overload them with letters as you suggested plus text messages of us discussing this.

A scan of her document is fine. She can e-mail it to you. TOS doesn't contain anyone's names. It just states what kind of business they have and what is expected from the members.

 

When you go to reply to someone it helps if they know that your replying to their post by using the "quote" tab within their post. You'll see it toward the end. Looks like this;

Whoa. I didn't say "overload". Those are your words. I said to take it easy. These people are trained to interrupt any document that you present for any unintentional information contained within. When they find something, and that maybe why they are on this fishing trip with your RFE, they will dig deeper. Embassy is the same way. These are experts, not just clerks your dealing with.

 

The requirement for the letter is supposed to be one from you and one from her. You never stated you had sent one, only that she needed to complete and submit one for herself. Big difference. Sometimes letters get lost and therefore it is not uncommon for us to see others, many others, receive a similar RFE for letters of intent. Just saying.

Bolded: The letter of intent must be for both of you. So either 1 letter signed by both of you or (preferably, IMHO) 2 separate, signed letters. Her intending to marry you alone is insufficient.

 

Underlined: This would be best addressed with a couple items as I am not sure from the wording if they are referring to your initial meeting or meeting in person:

1) State how you initially met via xyz.com. Provide evidence that they are not an IMB. This is typically via a copy of the site's TOS.

2) Provide information on how you met in person at least once within the 2 years prior to filing the I-129F. I'm not sure what you already sent, so this list may not be that helpful, but primary items would be things like passport stamps. Then receipts, invoices, event tickets, etc. showing the date and location. Last would be things like pictures.

Just saying it is "a dating site" won't help. If it is a paid site, then you have may some work to do to show that the site complied with the regulations.

thank you, I was able to send everything off Saturday and sent it express to arrive today. I sent a new one from letter (intent), plus my. i also submitted text that we spoke about our intent as it was one of the many ways to prove intent. individual statements on how we met, the terms of service from the site plus individual statements attesting to that we did not use an IMB. fingers cross.
