RTC Case filed after I-29 was filed

Timeline

We filed for a K1 visa in 2019 and is now waiting for NOA2, My fiance got into an accident and has proof that it was not his fault (MMDA witness). The person that was supposedly the victim filed a case aginst my fiance, how is that going to affect our petition? My fiance already got his NBI clearance in December and is cleared. But this case is filed in Jan 2020 and has a court date of Mar 2020.Can someone please enlighten us on how we will go about this. I am worried that this will cause a delay of us being together. Thank you in Advance

Won't affect the petition.

 

As for the NBI ...   Depends on the outcome from the RTC hearing.

 

Embassy prefers that the NBI not be older than 6 mos.

If the court dismiss the case (finger cross) do we need to bring this up on the interview? Since we answered no previously on the I-29...or do we need to say anything?

You don't need to bring it up to the embassy no matter ..    Only answers questions as asked.  Do not volunteer information or get chatty.

 

A traffic matter in court isn't anything to get stressed about.
