Did you not attach any tax transcripts/returns with the original I-864?

I attached everything, my issue was that I filed the I-134 not the I-864. Ugh.

for the past 5 years he was living/working with me in Canada. He still filed here but it was a $0 income. 
 

I previously attached all Canadian transcripts from previous years. Just with the wrong form unfortunately. 
 

to summarize my question:

if current income does not show 125% over poverty is ‘money in the bank’ considered (we literally have enough saved to buy a house...almost)

Oh no! That's okay though, it should be an easy fix.

 

So if your income is not 125% over the federal poverty limit, your husband will need to have at least 3x the amount of the difference in his income and the 125%, and it must be liquid in a year. So let's say he makes 30,000 USD/year but the 125% for a household of 4 is 32,750 USD. So he would need 3 x 2,750 = 8,250 USD in the bank which it sounds like you have more than enough. 

 

However, they usually like to see a steady amount in the bank for a minimum of 6 months to a year to make sure you didn't just transfer that money to show that it's in your account for the purposes of immigration only to transfer it back to the original source of funds. 

 

You can use your assets to cover the income requirement, or you can also get a joint sponsor (if that is an option). I only worked for 6 months out of last year, with no tax history at all at the time of filing. Not even one transcript because I graduated in December of 2018 and didn't work until June 2019. Even though my income for the year was higher than needed for a household of 2, I had my sister as a joint sponsor to alleviate any room for doubts. 

 

Personally, I would use assets and if it's a possibility, also add a joint sponsor just to make the case airtight. I hope this helps - try not to freak out - it's just a small obstacle for now which will seem like nothing in the near future :)

I think you’re right in suggesting a joint sponsor. Does that mean we need an I-864  and an I-864A for each of us (myself and 2 children?)

You will only need one I-864 as your children will be listed as family members on the same form, assuming they are unmarried and under 21. 

If your joint sponsor lives in the same household as you then you will need I-864A, but your husband will only need to fill out I-864.

I don’t understand! Expedite request was approved may 15. “Additional info received” on June 1st - even though nothing ‘additional’ was sent. 
 

received RFE last night for I-864 - priority expressed it this morning. JUST received a “expedite request denied” on My I-765. 
 

what is going on. Freaking out!!

Wow I am so sorry to hear that. It really makes no sense. Was your congressperson able to get any insight from the congressional liaison?

I think the reason the expedite was denied is kind of automatic if you received an RFE for the I-485. An RFE for AOS stops all processing of the EAD and AP, so that is likely why they denied the expedite as with an RFE it's no longer eligible to be expedited until the RFE is responded to and resolved.

 

Once your RFE is received by USCIS and assuming they are happy with what you sent, your EAD and AP should be approved shortly afterwards. It's unfortunately going to be delayed :(

 

Can you ask your new job if they are willing to work with you through this?
