We finally got the recieved text last night at midnight! Big relief!

(sent 14th)

            K1 Visa             

Sent - 26th Aug 2018

NOA1 -  6th Sept 2018

NOA2 -  23rd Feb 2019

NVC sent to embassy - 2nd April 2019

Medical - 21st May 2019

Interview - 31st May 2019

Approved! 

K-1 in hand - 10th June 2019

POE - 4th July 2019

Hello everyone! We sent our AOS on January 29. And I got the delivery confirmation on Saturday, February 1 that it arrived at the Chicago Lockbox. I’m joining the February filers but I’ll also follow here. 
 

I read on the saved post here that the employment (verification) letter should be updated and not the one from K1. Husband and I didn’t get an updated one and sent the one from last year that we used for K1. We also didn’t include his paystubs but we did include his W2’s from 2016, 2017, and 2018. Am I gonna get RFE

No one here can tell you that with  any certainty, but yes it's  possible. I could not tell how long ago you filed your K1 from your time line.  There is a reason they want current information. You'll  just have to wait and see now since you already filed your AOS.

Hi @Sarge2155! Thanks for your reply. Our K1 was filed September 2018 but the employment letter was dated May 2019. I’m hoping that it’s not gonna be a straight denial and just RFE just in case. It’ll take some time before we found out since we just sent it. But thanks for your response!

You could ask in an a different thread with people who have completed their aos? They might have more experience. 

 

We didn't send an updated employment letter (didn't know we should), only sent 2018 W2 and 3 pay stubs if it makes you feel better.. 

As long as it evidences what you have said in the forms, I think it'll be fine! 

It's all fact then evidence, fact then evidence. 

 

Side note, we did get a RFE in the K-1 because husband didn't include the final divorce papers signed by the judge, just the pre-final one(for previous marriage). And he sent it back 2 days later, only delayed us by a week or two so even if you do get one, it's not going to add months

No they won't  give you a flat out denial for that. Anyway don't  let it get you down, let it be business as usual. Just keep in mine that each case is different  and usually adjudicated by a different  officer than other people. You'll  be fine I'm sure.

That makes me feel a bit better. Thanks so much for taking time to reply. I’m anxious atm but gonna wait for what’s gonna happen since we just sent it. 
 

we didn’t get any RFE during the K1 so I’m crossing my fingers to have the same during AOS but if we will, I’d rather have RFE than denial.

Look at it this way - we've already been through the K-1 which means they concluded that your relationship was legit and gave you the go-ahead to enter and marry in US. To me, that's the biggest deal. This bit is just OK so youre already here, you did what you were meant to within 90 days and want to stay- let's make sure partner can afford it and everything is in order and legal. 

 

Once you get the notification they recieved it, its a relief they didnt reject, the rest is just the painful waiting but it's out of our control now so breathe 🙂

And congratulations on baby!

Awww thank you so much! You really made my day and calmed me down a lot. Husband told me not to worry and if they deny, we will just refile. I just don’t want the fee to go to waste. But what you said made so much sense. Thank you! I’m gonna relax now because as you said, it’s out of our control now and just gonna wait whatever the result will be.

An updated employment verification letter does not matter that much, especially if you are working at the same place when the K1 was filed. If you submitted the K1 September of 2018 I am guessing the letter is dated sometime in the summer of 2018. What matters mostly is that you submitted your taxes with the W2 Forms to verify the income. You submitted the last three years even though you do not need to, so you're good. You only have to honestly include evidence for last year's taxes, even though you do need the information for 17 and 16's taxes.

 

Honestly, pay stubs is something I would find more important, because technically someone could have their W2's and doing well on income for the previous year and currently be unemployed. However, by the time you have the interview you can update all the financial documents. They might RFE for the lack of evidence overall, but more than anything else they look at taxes. Like mentioned earlier for sure they will not deny you right off the bat for that. They will give you a chance to respond.

 

Some people don't like RFE's but I do not mind them honestly. I actually don't see them as time wasters as other people. They also let me know that the officer currently has the file on hand. When you respond from my experience the wait is not that long. As long as it is not a complicated RFE, such as "you came in with a parole document, when most in your case would not be granted a parole document, explain and provide evidence that your arrival was a legal entry blah blah blah lol". Those take forever because they need to pass it to a supervisor lol. However, some RFE's are easy fixes.

Hi! Thanks for taking time to reply. Our K1 was filed on September 2018, but we did get an updated employment letter dated May 2019 for my K1 visa interview (just in case they ask for it which they didn’t). It was a mistake on my end for not asking husband to get an updated one for this year. 
 

We did not include his paystubs too. I only included the W2’s and tax returns for 2016, 2017, and 2018. 
 

And as for RFE, I honestly agree with you. I mean they are not fun but I’d rather get them than a straight denial. Which you guys told me they won’t so I’m so relieved knowing that.
