i-130 online filing questions.

I have gathered all the documents and photos for the i-130 online filing and am starting the process now.   I hope to submit everything over the next handful of days.  I am hoping that I can use this thread to ask questions to the community about things specific to my case, and maybe help a few people along the way.  Thanks in advance.

 

I am living and working in Japan and will be returning back home to the Chicago area on July 27th, 2020.

 

They ask for my current phone number right off the bat, which is my Japanese cell phone number.  I entered the number but without the US exit code and Japan country code.  I assume I can make a not of this somewhere later.

 

For the mailing address should I use my US mailing address, which is my brother's condo?  And then select "no" for not currently living there?

Another question.

 

Under the evidence portion is asks for proof of legal name change of beneficiary.  She has taken my last name.  I have the official Japanese document showing the name change.  Does this have to be translated?  Or can I just upload the Japanese document?

Yes, you can put your brothers condo. Once you move back to the states you can update your mailing address online as well. Your marriage certificate is proof of name change

On the website it asks for beneficiary passport photos.  On everything else I've read they aren't necessary if the beneficiary is living outside the US.

Everything is coming up to speed nicely.  I have the proof of ongoing marriage all ready, and almost all of the online information completed. I have a few questions.

 

1.  Her most recent i-94, aka "admission record number" was on her old passport with a different number.  The old passport number is listed on the i-94 document that I got from the customs website.  So I'm assuming I don't need to include the old passport number, just the most recent i-94 number.  Right?

 

2.  "At which USCIS office will the beneficiary apply for adjustment of status to lawful permanent resident?"  I will enter the Chicago office, but is this decision locked for good?  I don't see us moving anywhere, but it is possible.

 

3.  "Native language". The online filing form is asking for a document, in Japanese, that shows her name and foreign address.  It doesn't ask for a translation (NICE!).  I'm thinking of including a scan of the legal document she received when she changed her name.  Should be fine right?

 

4.  The proof of ongoing marriage evidence has to be files no longer than 6mb.  Is there a limit to the number of files you can upload here?  The evidence including pictures, timeline, flight receipts, etc. isn't giant but it will be multiple 6mb files for sure.

Another question.  My wife will be receiving her new passport next week that will reflect the name change, which also changes the number.  I wanted to get the i-130 submitted in 3 days but this pushes it back a few.  Definitely need that newest passport number on the i-130 right?

The key is that you not need to submit the name change document.  If you decide to submit it, submit a translation with it.

 

Marriage certificate now, plus a new passport later showing the married name, will be sufficient.

Thank you!  How about using the name change document for the "native language" document?

There is no requirement to submit any "native language document", so I don't understand the question.  Please clarify.  Anything submitted to USCIS needs to be translated.  At NVC and Consulate stage, native language documents are OK, as long as they are in the local language where the interview will take place.

I cannot login right now because I'm at work, but there is section called "native language" that asks for a document showing the beneficiaries address and name.  This is the only spot I've seen in the online form that doesn't ask for a translation.  Everything I've read about the i-130 doesn't mention this native language document at all.

Not native language document.  If the beneficiary's language uses a different alphabet than the Roman Alphabet (ABC's) then their name and address is entered using that native alphabet.  This applies to Chinese, Japanese, Korean, etc., and former Soviet Union countries using the Cyrillic alphabet.  Alphabet, not language.  Enter, not "document".

 

Please become an A-Student of the I-130 instructions.  Read carefully.  Interpret literally.  Avoid "in other words", and use the actual words you read.  All this will be critical to your ultimate success.

I suggest you upload your beneficiaries passport bio page or birth certificate to that if their passport or birth certificate displays a name with any special characters such as š, ñ, ć, ü, etc. or any other typography such as Japanese, Arabic, Cyrillic, etc.
