If she can self fund any costs then she does not need Insurance.

Your wife will have to be her sponsor.

It's not required but it is very expensive to use medical services without insurance. 

As an example. When I just moved here I got in the minor car accident and I wasn't planing to do so) What I'm saying even if we are not planing to see doctors sometimes you just don't have any other choices. My leg was broken (nothing too serious) but I needed a surgery anyway, just a surgery alone cost $25 000.... Plus several doctor's appointments, x-rays and so on and so fourth. I meant it's a perfect situation if none of us needed to see a doctor but you never know.

So, essentially, how long does the AOS take (I now understand the conditions)?.

 

...or, as was the first reply: " Or your wife can apply using the I130 from her mother .. she must return to her country before the time allowed for this visit is over .. and complete the IR 5 process from there. 12-15 months roughly from filing the 130"

 

Does the 12-15 months include the time she is in the States, or commence once the application is accepted?  Thanks again!

Be practical. What happens if she is in an accident? Gets appendicitis? Etc. never mind the law, think about the ridiculous cost of healthcare in America and what can happen when something goes wrong, which can happen to even perfectly healthy people. Do you guys have tens of thousands of dollars lying around for something like emergency surgery? If yes, that’s fine. If not, get insurance. If you still plan to get a green card, which really doesn’t sound like the right option imo.

The length of time AOS takes depends on local field office. Some are a few months. Most are around a year or so. Some are closer to 2 years.

An individual case can take less or more time than average.

Assuming your profile is correct and she would be living in an area covered by the Chicago FO, USCIS shows 6-24 months.

 

She can travel back for visits to China (or elsewhere) with AP. This can be filed alongside AOS at no extra cost. This is taking ~4-7 months on average.

 

If her intention is not to live in the US as her permanent residence at this time, then AOS is not suitable. She will be required to maintain her permanent residence within the US. Visits abroad are fine, but she can't be living in China and maintain the green card. Just want to make sure this part is known beforehand...some people do try to use a green card as a sort of "super tourist visa".

If she will live in the US as her permanent residence, then AOS is a valid option for her.

Correct, AP (in this context) means Advance Parole.
