Hello all,

We sent our AOS package to USCIS on Feb 17, arrived Feb 19. Received texts with case numbers and checks are cashed Feb 27. Now we wait for Biometrics.

 

I have a question, I have multi entry H1B visa which is dual intent, can I travel on it before AP is approved? or will my application become "abandoned"

Yes you can travel on H1b but AP will be denied if you travel before its approval.  you will have to refile AP once you return. No issues with I-485 though

No don't worry. They will use the information from your BIo to all applications that need biometricts for up to a year, so you are all good.

Thank you for the clarification.

 

Additionally, can I request expedited EAD in case of a job offer? Or they will deny because I have H1b and currently work and it not severe hardship (career advancement, was not fired)?

dont think your case qualifies as expedited unless your new employer does not sponsor h1b transfer and you would need to work for the new employer. it depends on your situation

Charged credit card today but no receipts or case number yet.

Awesome. call the 1-800 number for receipt numbers. they will have it once the card is charged

Well, I was smart enough to provide my name and comment that I am not a petitioner for I-485 and rep refused to give me information))))) I filed for my parent ))))

Hi, Everyone.

 

I mailed my AOS application ON February 24, 2020 at Chicago lockbox and USCIS received the package on February 25, 2020. I did know about the public charge rule but I didn't know some forms were updated like I-485/I-864 and you also have to submit an additional form I think. I've used old edition forms for I-485 and I am freaking out because I know my application is going to be rejected because of that. Does anyone have any idea if they're going to return my package? and if I have to pay the fee again and re-send the application? I haven't received NOA/Text msg or anything and I am so stressed and not sure what to do. Also, I am on STEM OPT which doesn't expire until February 2021 so if my AOS application gets rejected then will it affect my existing OPT?

If they reject they will send you the entire application package back to you. It will take a month for the rejection package to arrive. You will refile the application.

Not sure about the rejection package but I don't believe this will effect your current status in any way. Also, as long as you re-file everything (that is if you do get rejected) before your current OPT expires and your status is pending, you should be okay. Good luck with everything!

I'm in a similar situation. I do not have a job offer yet but I'm wondering if I should even apply to jobs right now since I won't get my EAD in time. I think if you could maybe prove that you are no longer employed at your current job, show all your bills and financial obligations, and show your new job offer, then maybe that will justify you being unemployed as a "financial hardship"?
