Hi everyone! I met my boyfriend in January and I plan to start the filing process at the end of this year. With the new ban on Nigeria, is it better to file a fiance visa or spousal visa? Which is easier in your opinion?

You have to be married before applying for spousal visa. And for fiance visa, you have to have plans of getting married once you get to USA within 90 days and your must have met your fiance in person before applying.

Yea, they will sgraight up deny any petition you file if you have not met in person. I have been to Nigeria 3 times and had planned to go again before this pandemic. We are at NVC stage now, thank you Jesus !! Best of luck!!

We've met before and have pictures. But, I do plan on going back in December and starting the filing process. I just didn't know which would be the better process. Thank you for the breakdown! @PatLuvO

This is my comparison, fwiw:

 

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1
    Slightly faster arrival in the US     
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)    
    Spouse can not work until she/he receives EAD (approx 5-6 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.

  

CR-1
    Slightly slower arrival in the US 

    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.

    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Im just putting this out there. Has anyone heard any news about when the state department might reopen reopen operations at the embassies? I’m located in Egypt with my husband. We had his immigration interview schedule for May 17 and it got canceled. Just imagine being at the finish line and it cancels and in the middle of a pandemic! Ahhhh! I can only laugh at this point. Anyways, I’m assuming there is no news but maybe I missed something. Thanks!

State Department has an outline about the Embassies.   I posted a link to the MSNBC story about it somewhere.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

If you decide on the fiance visa you can file now.

Hey people, how are you holding up? According to their update, Lufthansa will be resuming flights in June from Abuja and Ph to Chicago, New York and LA only. Check their website for more details. 

If there’s anything this pandemic has taught me it’s to make plans immediately!!! so if I were you......
