personally, I think it would be outrageous for them to let in k1 and not ir1; grossly unfair

 

I’m with @missileman on this... if spouses can’t travel, k1 will likely be affected also.. logically speaking a spouse is a current immediate family member, a fiancée isn’t, therefore a spouses entry should come before that of a perspective spouse. married couples genrally have far more to lose due to the separation, and the relationship and legal ramifications are far greater should the relationship fail due to said separation.

 

B2 visas are about to get way harder to obtain, they’ll expect an increase of people planning to adjust

The existing travel ban does impact K-1. My understanding is this was adding countries to the existing ban, not a separate ban.

Timeline

Please, my husband's interview is February 10th.

It seems to say if people have visas issued to them before february 22nd then you are exempt. So we still have a chance of him coming right? We have an interview! No email telling us anything has changed ect... So close! This is crazy

As written and if there are no changes, then yes it would. You would need a waiver to obtain the visa.

Who knows what will happen between then and now. Best thing is to file when ready, wait, and then address the issue if it comes up at that time.

The fact that the Supreme Court previously upheld the earlier ban (with multiple revisions) on the grounds challenged does not necessarily mean further suits might not have independent merit or might not result in stays. Actually, it’s somewhat debatable as an expansion of the previous ban when this ban doesn’t even prohibit non-immigrant visas from being issued (a distinction from the earlier ban), and by doing so (again, debatably) defeats the stated purpose for the ban. That said, if the stated purpose for the ban is the actual purpose, and Nigeria and others comply with the demands, one would hope Chad serves as the example of what should happen in quick order...a lifting of the ban once the requirements are met.

EDIT:  I really do find it strange that a K-1 would not be affected, yet a spouse would.......weird, in my simple mind.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you meant that K-1 was impacted by the previous ban, then yes it was.

My husband is staying sooo positive. He keeps saying this will not affect him. We have a very simple case. We were recently pregnant and miscarried I've visited 3 times he has no criminal background at all. Works for the government university. I Pray it is smoothe and visa is issued quick.

Thank you very much. Let me ask you. I hear people saying they have an issue date....what is that exactly? Like at the interview if they say you are approved everything is good do they give you an issue date?

Probably not until monday or tuesday in the Federal Register, maybe later especially if it going to modify an existing proclamation.

The date the visa is printed and placed in a passport is the issue date.

 

Usually anywhere from 3 to 10 days after the interview.

Everything I’ve read (so far) suggests those with a visa issued before 2/22 will be admitted, so if they are quick in issuing the visa, there’s a possibility. I would still steel myself for potential delays in your shoes, however, as there is never a 100% guarantee the embassy will issue the visa in that 12-day window. But it’s absolutely within the realm of possibility that they will issue the visa in time.
