Will this visa band Trump has for Feb 21 affect us? Our approval is set for sometime in April. My husband is in Nigeria.

I was told if you get an approval you should be okay. It's the new petitions that will be a problem.

I was told if you get approval you'll be okay. It is the new petitions that will be the issue. All this is tortuous to everyone with a spouse in these countries. My husband is in Nigeria as well.  Our case should come up around the first or second week in May, hopefully sooner. Let us pray that the ban will be lifted by then.

Yes my anniversary is coming up too March 8. Our petition has been in for almost a year. Our approval date is in April. I am going this month to stay for a while. I’m feeling heartbroken. Patricia, I hope this is true. I pray everyday. I just want to be with my husband. Thank you all for your responses. Wishing the best for all of us.

Approval and Issued are separate and distinct. If the visa is not ISSUED by the time the ban takes effect then the beneficiary will not receive a visa unless they are granted a waiver.

Remember an Approved petition or verbal "Approval" does not guarantee, nor is equal to an Issued Visa.

Please correct me if I am incorrect.  The burden of proof is on the applicant to show 3 things according to the Proclamation 13780:

Waivers: A consular officer may, on a case-by-case basis and within their discretion, grant a waiver to affected immigrants for certain reasons.

The person seeking entry must prove that: (

A) denying entry would cause the foreign national undue hardship;

(B) entry would not pose a threat to the national security or public safety of the United States; and

(C) entry would be in the national interest.

Some examples of this include:

● foreign nationals with significant past contacts, study, work, or business in the United States

● foreign nationals with immediate family members in the United States where a denial of entry would cause undue hardship to the foreign national

● people with uniquely compelling circumstances (such as children, adoptees, or those seeking urgent medical care)

● people employed by the United States government or an international organization

The waiver will be considered only for "close family ties" as defined by the Trump Administration.

That appears correct, but I will note that I have not been following the specifics of the types of waivers. They were fairly uncommon for the previously impacted countries. This expansion likely impacts a lot more applicants.

If his visa is not issued by the effective date, then yes, it will affect his case.  You can expect the process to proceed normally through the interview.  At that time, assuming there no other issues, the visa will be placed on hold until either the ban is lifted or a wavier is approved.

Hi everyone I filled I-30 back in November 2019 to bring my husband to the US. Would this band effect us? I am a US citizen

Yes, your application will be affected except if he is lucky to secure an appointment for visa before 22 February 2020, otherwise, we hope that the concerns by the American government on Nigeria will be addressed within the shortest possible time since Nigerian government has set up a committee to look into the ban and to address the issues raised.

So do I. I wish you the best of luck with everything. Let us pray Nigeria will comply with the security issues and they get taken off the ban before our cases are adjudicated.

Are you saying interviews would still be scheduled for dates after 21 feb but visa  issuance would be put on hold until the ban is lifted? The thought of that makes me feel better. Kindly clarify. Thanks.

What I just heard was if you do not have a visa in hand before Feb. 21 there will be no travel. I don't know exactly what they will do at that stage , unless the hold it until the ban is lifted or you get a waiver which I hear is complicated to get around.
