i have been trying to find the waiver on USCIS website for the INA restrictions. Any idea on what form should be used? Also at what point do we need to submit the waiver? Is it after the file is adjudicated. ?

It's not a waiver you can just apply for. The CO can recommend you for one after the interview, once you are determined otherwise eligible for the visa.

Good morning Lagos people, I just got off the phone few minutes ago. I talked to someone at the US embassy in Lagos about the visa restrictions and all, she said they haven't gotten any new information about what to do at the embassy but she is very sure the NVC will send us an email to let us know if the restriction will affect our visa.

My attorney said it is at the consulate stage.

You are right. Something to do with security standards 

Someone was explaining it to me today. Security concerns.  Here in the US, you can be tracked wherever you have lived.  They want Nigeria to put in place a system like that so that people can properly be identified and vetted.

You are permitted to file for them as a USC.

 

Their eligibility for a visa is the issue. They are not guaranteed any rights to immigrate or otherwise enter the US.

They can request a waiver after the visa interview.

Please correct me if I am incorrect.  The burden of proof is on the applicant to show 3 things according to the Proclamation 13780:

 

Waivers: A consular officer may, on a case-by-case basis and within their discretion, grant a waiver to affected immigrants for certain reasons.

The person seeking entry must prove that: (

A) denying entry would cause the foreign national undue hardship;

(B) entry would not pose a threat to the national security or public safety of the United States; and

(C) entry would be in the national interest.

 

Some examples of this include:

● foreign nationals with significant past contacts, study, work, or business in the United States

● foreign nationals with immediate family members in the United States where a denial of entry would cause undue hardship to the foreign national

● people with uniquely compelling circumstances (such as children, adoptees, or those seeking urgent medical care)

● people employed by the United States government or an international organization

 

The waiver will be considered only for "close family ties" as defined by the Trump Administration.

Yes.  The ban will affect your husband's visa.  Expect the process to continue normally through the interview.  After the interview, the visa will be placed on hold until either the ban is lifted or a waiver is approved.........Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As of now the ban is to be implemented Feb 22. As of that date Nigerians are banned from immigrating to the US without a waiver. A waiver can be recommended at the time of his interview. There is nothing at this point that can be done so one should just proceed as things may still change

I don't think anyone knows the answer at this time. I'm waiting for approval too. I will just wait it out. Its tough but its better to be calm.
