AP is open ended and every case goes through some form of AP. The 90 days is a goal. Most people takes days. Some take weeks. Some less take months. Rarely it can even take years.

 

There is no new law. Laws are created by Congress. This is a proclamation by POTUS. It doesn't make it less valid (the prior one was upheld by SCOTUS), but it is different than a law.

"Should" and "fair" are subjective. The fact is it is there now.

I am curious as well what this means. I started our K1 visa process a few months ago. Does that mean my fiance will not be granted an interview?! Or even if he is granted one, they will deny him?

 

What about my petition? Will they even review it?

The petition was be adjudicated like normal. No impact.

NVC will forward the case to the consulate. No impact.

The consulate will interview the applicant. No change.

After the interview, if otherwise eligible for the visa, they will refuse the visa under this proclamation. A waiver may or may not be available in your individual case.

What happens now with the new Trump travel ban with 6 new countries added to the list? Can a US citizen Or Green card holder still apply for a K-1 visa and K-3 and Spousal Visa like Cr1 for his/her spouse and will the visa get approved? What did you understand by this immigrant ban it’s confusing pls honest answer only

Hello, Due to the trump ban on Nigeria immigrants visa which starts on Feb 22nd, me and my wife will still be filling for the CR1 visa and just wait to see what happens BUT we are also thinking of applying for Canada student visa as an option B while waiting on the ban to be lifted so we can be together there..Can we apply for visa to both countries at the same time since it’s a different kind of visa or what would you guys advise? Thanks

Hello,

 

I wanted clarity on the recent information concerning Nigeria. I am a spouse of a Nigerian (I am the US citizen). He has a young child under the age of 6 and has not petitioned for her as yet. She is listed on the initial filing as a child my spouse has. What is the direction and how will this affect her?

My husband and I started out process as adjustment of status but I had a family emergency and had to leave the US and our lawyer advice we have to continue with consular processing and it’s has been a year now waiting for our i130 and he has an interview on the feb 20 for the i130 to be approved and now once it’s approved say by on Feb 21st what are we going to do with the new ban and now we’re expecting our first child together. I don’t know how this ban will affect us or if we’ll be qualifier for the waiver. 
This is very devastating

Hello dear, nobody knows yet..  we're all still waiting for clarification.. i am bothered as well.. let's hope for the best, and pray miraculously this ban is lifted off us who has spouses that we need to re-unite with.

The child hasn't had a petition filed - nothing changes.

USCIS will do their job and (eventually) adjudicate the I-130. That's what the fee covered. There is no change to USCIS here.

The visa application is what is impacted. Any immigrant (and possibly K-1 - not confirmed, though) visa on or after Feb. 22 will need a waiver to be issued.

No refunds. The fees cover the application whether the visa is issued or not.
