No.

You must file to remove conditions. 

 

You can apply for citizenship if you file your ROC and become eligible to file for naturalization while waiting on removal of conditions to be approved... But you have to file ROC. 

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

Impossible.......Conditions must be removed first.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You can file the N400 when eligible. They cannot approve the N400 until the ROC has been approved. I cannot find any information that says you have to have an ROC application filed (USCIS website).

It’s in your second sentence. They can’t approve N400 until the ROC has been approved. So you must file for ROC first. It’s also on the website. Only 2 exceptions. Unless you fall under one of those, you must file ROC first. https://www.uscis.gov/policy-manual/volume-12-part-g-chapter-5

In practical terms, many people are having both removal of conditions and citizenship adjudicated at the same time since the ROC timelines are so long now.  Unless you have some very special case, it would definitely be impossible to file for citizenship before filing for ROC.  It is OK to file for citizenship if ROC has not yet been approved.

May 14, 2016: Sent I-130 Package to Chicago Lockbox

Oct 21, 2016: NOA2 Notice by App (LIN)

 

NVC

Nov 8, 2016: NVC Received

Nov 16, 2016: Case Number Assigned

Nov 18, 2016: DS-261 submitted and AOS fee paid

Dec 5, 2016: NVC Scan Date

Dec 6, 2016: NVC 3 N/A and Case Complete on Phone [1 day later!]

Dec 13, 2016: NVC CC e-mail

Jan 23, 2017: Interview...Approved!

 

Removing Conditions

Nov 2, 2018: Sent I-751 to Arizona Lockbox 

March 3, 2020: Approved by CSC

 

N-400

Feb 2, 2020: File N-400 online

Feb 25, 2020: Biometrics

If you can't have approved n400 without adjudicated i,-751 then it's clear you must file the i-751 in order to be able to apply for citizenship.

I agree with you in a practical sense however there appear to be at 2 exceptions to that rule.
