But in the form they ask for 3 years, should i say i dont have 3 yrs...that's the confusing part

You have to give your tax information from the last 3 years, but you don’t need to have all 3 years above the minimum to qualify as a sponsor. It’s your current income right now that matters, not your income from 3 years ago. As long as your current income is sufficient that’s all you need

Our CR1 Journey:

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

October 11 2020: Arrived in US!

Is it really needed for everyone?

I was unemployed when I submitted my documents, but I started working the next week after my submission. I only stopped working 7 months because I lived abroad for 7 months. what should the letter say?

I don’t know if it matters but I wasn’t working when I submitted docs for my husband but had my brother as a joint sponsor and only submitted his tax transcripts, current paystub (add doc) and W-2 WITHOUT an unemployment letter from me and all my docs got accepted!

“No” and then write your income for each of those 3 years (with 0 for the year you didn’t work of course)

thanks for the information

I really appreciate that.

I used my stepfather as a joint sponsor and I had income enough based on my last taxes return, but was employed at the time of interview. So probably I won't need either

Any DQs recently?  Feel like it's been quiet and slow-going (what else is new) from NVC lately...

I think they're working on Dec 20th cases now.. but I saw someone got DQ'ed second submission is on Dec 27th... NVC is really confusing. lol

I had a look at your timeline and saw your I-130 was received just over a week ago at Nebraska. Unfortunately they're notorious for being extremely slow, so by the time your I-130 gets approved, gets to NVC, is assigned a case number etc. you will most likely have 3 years of tax paying history under your belt. Since your case is at Nebraska, NVC stage isn't something you need to think about for a while, sadly. I hope they start speeding up though.

and how this was possible because we have already been through a family reunification visa process, but in this case I was the petitioner and the beneficiary was my husband... I am done with visas for a looong time after this horror movie call getting a green card!

Just out of curiosity - is it a similar process for Germany?  Hope you don't mind me asking. Thank you :)

Finally submitted all the documents to NVC. Let the wait begin. Hoping Montreal catch up on backlog by the time our file is forwarded to them 😁
