No it’s not unless she intended to adjust status when she entered the us. Entering the us through a visitor visa and adjusting status is not Immigration fraud per se unless the intent was there. It’s a very subtle but important difference.

As mom has not entered yet but the question is being asked then intent is expressed = fraud.

With your current income and supporting documents, you would qualify.

Please be aware that each parents petition is separate .. so when you do the I864 for each of them, your household number with be 3 plus 1 potential immigrant .. total 4...  not  5. You don’t add the other parent to the i864 as both are being “applied for”... neither are issued .. so you are not currently supporting either of them.

Paystubs and employment verification letter from employer with salary information should be sufficient.

A parent could a 40 year old highly qualified who could expect to walk into a well paid job or an 80 year with multiple chronic conditions, different situation different answer.
