Just a question related to your timeline: so you've mailed your application before the public charge took effect and still received your application back. But how did you respond? Did you include proof that you mailed it before the due date? Or you just filled again with all the requested documents?

 

The reason I am asking that I had a similar case, but I receiced RFE and the application was not rejected (received NOA 1 month earlier). I replied with proof that I mailed before the due date (waiting for their response on that)

- Feb 22 2020 - Mailed Application (I-130, I-845....) to Chicago

- April 22 2020 - NOA 1

- June 1 2020 - RFE for I-944

- June 24 2020 - Replied to RFE

- Oct 25 2020 - Fingerprint done

- Nov 9 2020 - Case ready to be scheduled for interview

ASC is the one that those stuck in the biometric limbo need to look at. 

USCIS said they are planning to reopen ASC and resume biometric services on July 13, so that those scheduled biometric appointments on March 18 may get updated appointment notice next week. 

I guess I may be able to get updated appointment in mid-July and do it by the first week of August (Mine was initially on March 31th) since they said they are going to reduce 50% of their capacity for in-person services. 

 

BTW, it looks like the second wave of the coronavirus reaches the US. 

Everyone in this February filers spends a particularly hard time, gets anxiety, and I am as well, but I hope everyone keeps safe and keeps healthy.

Well, my application got rejected, and there is no way to fight/appeal a rejection. All I could do was to send in the application again, and include the I-944 and all other requested information. It wasn't as bad or lengthy as I initially feared. I didn't include proof that their first rejection was in error because I realized that it wouldn't benefit me to point out their mistake (even though I wanted to).

 

So you did not send in the I-944 in your reply to them? My thinking regarding anything USCIS ask for is that unless it is too burdensome, I will just give it to them. The alternative could be excessive delays or a denial, so even when they are wrong, it might be better to just comply.

Concurrent I-485/I-130/I-765/I-131 Filing (married to USC spouse):

Thank you for your response.

Its part of the process. No point arguing with them about whats you feel is right or wrong. Just give them what they want and you will get your task easier. At the end of the day who will the loser - applicant whose file gets delayed cause adjudicator thinks he needs the paperwork to justify adjudication.

I didn't request USCIS to expedite my I765. I just waited and I got approved. My son's applications haven't been approved yet though so once I got the acceptance letter, I'm going to give them a call and ask for my son's status.

Hello, do you have any news about your k-2 approval? I have the same situation I 've gotten  noa-2 ( I-131 and I765) but no news about my child' s documents :((

Yes, I agree. It's part of the same process that reminds me of my third world country, where no accountability or law exist...There, for example, when a police officer said you are wrong, even when you are right, you are still wrong and must comply to whatever she asks.

They are demi-gods! At least, no one else has the ability to be able to drastically change my life as quickly as USCIS potentially could.

This is just a question of what is best for you at this moment. If you fight them, you might win, but the delays that it caused probably didn't make it worth it on a personal level. So we just follow the rules and their instructions. We should remember this process after we are done with it though, and if we ever end up in a position where we can contribute to meaningful change, we should embrace it. For now though, keep it simple and just get through the process.

For those of us waiting for biometrics, they have updated the office closure page with ASC re-opening dates. Most of them look set to re-open on the 20th July.
