Yes ASCs too, where the biometrics are done!

Citizenship Complete!

**Sigh** i just missed out on getting biometrics done by like a day before all the closures happened...is there definately no way of ead being processed without biometrics?

i've read a few different threads from previous years where EAD/AP have been approved without biometrics, although really rare... so i'm hoping COVID19 has made them reconsider doing this again otherwise how will they deal with the influx and processing of the applications that have been stacking up? so fingers are crossed here for sure.

I am wondering about this too! Anyone who has been able to get an EAD expedite considered without biometrics? 

I asked this question to a Tier 1 USCIS representative, and he didn't really know. But he submitted an expedite request for me, but it got denied because I haven't done my biometrics. :(

Maybe more of us should call them and ask for EAD expedite even though we don't have our biometrics done?? If they wanted to, they could make an exception!

Concurrent I-485/I-130/I-765/I-131 Filing (married to USC spouse):

2/23/2020: Sent in application via FedEx (following rules before new Public Charge rule) 

2/25/2020: Arrived in Chicago, IL
3/13/2020: Packaged received in return and rejected due to "outdated forms"
3/24/2020: Refiled application with new forms including I-944
3/25/2020: Arrived in Chicago, IL (received by Harper)

4/13/2020: Received 4 late-night texts with case numbers
4/14/2020: Application fee withdrawn from my bank account

4/17/2020: Received hard copies of Receipt NOAs (I-797Cs)
4/17/2020: Requested EAD expedite
4/20/2020: EAD expedite request denied: Case in "in suspense or on hold until we receive your biometrics" +  did not provide evidence of "extreme emergent need"
8/1/2020: Received biometrics appointment notice (for I-485 and I-765)
8/11/2020: Biometrics appointment at the ASC in Sacramento, CA

8/12/2020: Online case status for I-485 and I-765 updated to "fingerprints related to ... have been applied to your case"

Yeah I really hope that just because we missed out on the appointment our cases arent just gathering dust somewhere on someone's desk until we get them done.

I fear that is currently the case. 😕 When I got my EAD expedite denied, the email said:

"Your case is currently in suspense or on hold until we receive your biometrics."

 

To me that sounds like they are doing nothing on my case until biometrics is completed. Meaning, not only will they not give me an EAD, they will not see if they need to send out a RFE or make any other progress before it's completed...

How to encourage USCIS to make an exception??

I didn't know this part. I thought you can always expedite. I assumed the expedition can be done for biometrics too. You can formally request it only after you've completed the biometrics? Local USCIS offices have been closed for a long time and I am worried they have a lot of biometric appointments to go through after it re-opens. Who knows if they will be open in June.

Yes, that's what I have learned from these forums, and from my own experience. There are some threads on people getting their EADs without biometrics, but they are from ~2016 and older. Not sure if that still happens. Hope they will make an exception given the circumstances!

Those are my worries too. I don't expect the USCIS offices to open before much of the society at large is open. Also the backlog of biometrics appointments will be huge!

I’m in the same boat with biometrics not completed before the USCIS closure . Now cases are most likely on hold until the offices are open creating even more backlog . Even then there’s no telling when we’ll be hearing anything. I just wish there was an exception where they could’ve just waive the Biometrics appoint or just even open but to only a limited amount of people.

I wanted to request for an expedite but then was reluctant after seeing recently submitted expedite requests got bigger chances of getting denied (for weak proof, some said job offer that not medical-related may not be enough, especially in these weeks since USCIS started prioritizing expediting cases for healthcare workers / humanitarian reasons)

Also, some rumors say that if you got denied, your application goes back to the bottom of the pile, this scares me. Rumor is rumor, could be true, could be wrong, but I couldn’t find a definite / official saying that states denied expedite request won’t send your application to the bottom pile.
