I called them before sending the application and asked if I would need to filed the I-944 and they said I did not have to. Is that correct? I am so confused with all these new rules and forms.

It depends, did you mail it out, and as such is it postmarked with the 23rd or earlier? Then no, the version of the form you used is fine and you don't need to file a I944. If it had 24th or later on it, then yes you need the new version of the form and add I944.

Hi All,

 

New to the thread, but not to Visajourney. Many of you I recognize and have helped me while my (now) wife and I were working on our K1 visa.

 

As of now, we are waiting for our NOA1 for the AOS packet we submitted on February 20th. I'm.....mildly concerned at this point we haven't heard anything. I've read a lot in the thread about old forms as well. 

 

It seems mine was the July 2019 form that expires in 7/31/2021. Will this be a problem? 

 

I think with all happening in the news, this could also affect our case processing times, so we're expecting a bit of that. But mostly I'm worried for my AOS that I made a mistake or used the wrong form and that's why I haven't heard anything back yet. 

 

Anyway, looking forward to chatting with you all more!

I mailed it out on the 25th. Do you know if I can submit a new version of my application without having received the rejection note? Thank you for all the help!

You can submit a new packet as if you never send in the old one. The issue is however, that in the very very unlikely event that they did accept your initial packet, they might cash both cheques. So it's best to have at least some kind of confirmation that the initial packet was rejected (by virtue of receiving it back or receiving confirmation through email).

Thank you. I will probably wait to get the notice then. Do you know if I need to submit everything again? I submitted the following forms with my I-485 package:

I-864 - Affidavit of Support 

 

I-765 - Application for Employment Authorization

 

I-131 - Application for Travel Document

I am not sure if I would need to fill all of them again (on a new form) or just the I-485 and the new I-944?

Tomorrow will mark 3 weeks since USCIS received our application (mailed via USPS Priority on 02/22 and received 02/25), and we’ve had no movement. No cheques cashed, no notifications, no returned packages.

I'm a day behind you and havent heard anything either. I know its worrying but just have to stay calm I suppose. Hoping to hear something this week but I'm not sure  how much the virus  is affecting everything.

Everybody hang in there. It’s chaos at USCIS right now because of the implementation of the  new rule and coronavirus.

 

I know the wait is torturous. I’m in the same boat. We shipped our I-485 to the Chicago Lockbox with USPS on the 22nd and it’s been radio silence since.

 

From what I’ve gathered and synthesized across forums and friends, packages that were shipped with commercial carriers near the deadline are getting rejected because the postmarked rule doesn’t apply to commercial carriers like UPS and Fed Ex. Unfortunately, USCIS does not seem to be following their published language that the date on the courier receipt counts as the postmarked date.

 

If you sent it with USPS, which does postmark envelopes, before the 24th, your file is likely sitting in a giant pile awaiting action. There is hope, because postmarking takes on a different meaning and I believe that USCIS is more likely to follow the rule on “officially” postmarked envelopes via USPS.

 

Also, there was a mad rush to file before the new rules went into effect, and it’s slowed everything down.

Yeah we may be looking at a perfect storm of the new rule change plus the state of affairs with the pandemic. While I hate to see others waiting around as well, it's sorta reassuring that I'm not the only one that is about 3 weeks out so far.

I hate to tell you this but our law business is teamed up with USPS for most things. We send everything out through USPS and on rare occasions we use other carriers. However, the packet we sent to USCIS on the 22nd and arrived on the 24th. However, it was received by USCIS on the 25th and was rejected for being outdated. I am not saying this to scare people, but simply to state there is some incompetent people out there lol. Also, 6 other packets were sent the same way with similar received date and those were processed just fine. In other news, wish me luck guys I need to translate for an AOS interview today at one of the busier USCIS offices. That LA waiting room is huge.

I talked to a Tier 2 and they told me I had to go and do biometrics again for I-171. Annoying, especially considering the current state of things.

  • March 19, 2020 - RFE requested
  • April 20, 2020 - Response to RFE received
  • April 27, 2020 - EAD expedite requested, evidence requested and submitted
  • April 28, 2020 - Request for additional information received
  • April 28, 2020 - New card is being produced!!
  • May 1, 2020 - Courtesy letter about medical exam received
  • May 5, 2020 - Case ready to be scheduled for interview
  • October 19, 2020 - Interview scheduled notice
  • November 10, 2020 - Interview date
  • November 12, 2020 - AOS approved

No don't  submit another packet until you get a rejection notice. You just have to wait it out. Don't  do it!


4 years, 11 months, 2 weeks and 3 days

Citizenship Complete!

Sent 02/22/2020, received on 02/26/2020. I called USCIS this morning to ask about my packet, they said I'm not in the system yet as it hasn't been processed, then told me to wait. I called my bank to see if my cashier's check has been cashed out, and they said it has not. Waiting...

K1 Entry 12/27/19

Marriage 12/29/19

AOS mailed in 2/18/20

AOS received 2/20/20

Biometrics letter received dated 2/28/20

Appt was 3/17/20 but we went to appt center at Gardena and walked in on 3/13/20 no problems.

ASC at LA and La Brea not helpful and want to go by the book on appt time.

3/15/20 received sms that I485 and I765 have fingerprints attached to the MSC file.

 

Now awaiting USCIS response.

I haven't received any receipt number yet and our cash was not cashed out. I am worried about the new rules and new forms but they did not inform us of anything new. Our form was the 07/15/2019 version and the expiration date  07/31/2021. I called them today and they said e-mail the USCIS LockBox but they haven't replied yet. 

 

Can anyone assist me on this? Do I need to file everything again? Tomorrow will complete 3 weeks since we sent it and they havent reached out so I am starting to get concern about this.

My understanding was postmarked before 24th for old form, after feb 24th is new form.   Not sure new form released at your date of mailing but I think you used the old form as you mailed on the 25th.
