Hi all...

 

after so many months of no news, biometrics canceled in March and EAD expedite denied in June, I just kinda gave up on checking everyday to avoid the disappointment. 

fast forward to this month - did biometrics on Aug 21st, didn't notice it was only for I-485/I-765.

Ah. I moved in June. The person who now lives at my old address was nice enough to let me know that an immigration letter arrived at the old address. what? Went to pick it up - another biometrics appointment notice for I-131 (code 2) for September! What! I would have never gotten it if I wasn't in contact with the new tenant person. 


Called USCIS. Tier 1 confirmed with me that my address is all changed and good since June. He thinks it was a mistake with the second notice and it was strange with it sending to my old address, as everything he can see he does not see my old address.

Tier 2 called back, very impatient and rude :( told me the biometrics I did applied to only the AOS/EAD, but did not apply to the I131. "you just gotta show up, we will not continue to process your case if we see no biometrics (!?) applied to your I-131. if you have any questions visit our website, have a great day" then she hung up on me!

I was so upset yesterday after that phone call.

So I thought, okay, I wasn't gonna not show up to the second biometrics, I was just worried about the address and if something is recorded wrong in the system..

 

Then, just now, I tracked my case, and AOS updated to "we scheduled an interview for your Form I-485 ... we will mail you an interview notice"

!??
completely unexpected but has this happened to other Feb filers here?
I also have not done I-693.
Question is, should I now just schedule the I-693 asap, or should I wait for this interview notice to show up first? I don't know how much time I have between getting the mail and the actual interview, and part of me feel like this update could just be fluke... 
And I will still go to get that second biometrics done....


If anyone has some useful links on preparing interview, I would also really appreciate it! I am F-1 (graduated) to AOS family based

Hi Everyone,

 

I received a response from USCIS today asking to fax them evidence of severe financial loss for the expedite request. I do not have a current job offer, but following are the docs I'm planning to submit. Do you think any other proof would make my case stronger? Also, please advise if I have to include a cover letter and anything else I should remember?

 

1. My bank account statement

2. Statement of credit cards & other debts

3. Proof that my wife lost her job due to Covid in April

4. Proof that our only source of income is her unemployment benefits and the additional $600 relief benefit ended as of July

5. Eviction lawsuit filed by our landlord due to non payment of August rent

6. My job offer from Dec 2019 and an email from employer that they have to revert the offer due to lack of EAD

7. My W2s between 2014 & 2019 - Shows that I worked here on H1B for 5 yrs, so I can get good paying tech job only if I have EAD.

My I-485 status changed to "we have scheduled an interview" a few days after I took biometrics on August 14th. When we will receive letter, I'm not sure, but I am assuming the interview won't be for quite some time. I'm going to wait for the interview notice to show up before I do anything else. Also, my fingerprints for AOS/EAD ended up being applied to my AP as well. Good idea to get the biometrics done, though!

I would do the i-693 because some clinics and hospital aren't taking that many appointments and especially with the USPS delay you might get the letter a week before or even days before for your interview. It lasts for 2 years so why not

I did the same thing yesterday.

 

I wrote a cover letter outlining my situation and why I feel my case should be expedited. Mainly on grounds of financial hardship. But I also mentioned in my cover letter that we applied early enough to be adjudicated before or shortly after MY EAD would've expired. I also mentioned the bs biometrucs rescheduling situation, which is the cause of my application being delayed. I said that consider that an error by USCIS. To state as many reasons to be eligible for expedite.

 

My supporting documents were: 

- bank statements 

- furlough notice & updates from my current employer 

- expired EAD (conditional) 

- lease and recent payments + recurring bills

- expiring health insurance 

- upcoming job interview  

 

I sent them 25 pages. I also think you may have better documents than myself. So good luck!!  

 

Also, don't forget to send the USCIS email with your packet! I forgot and sent it in a separate fax. Fingers crossed that didnt mess up my case.

 

Btw, I haven't recieved a receipt email from them yet. Hopefully that'll come soon. I don't know how long it usually takes for them to send that out, I was hoping they'd confirm receipt immediately:(

I didn’t get any receipt email from them when I did mine (not sure if it’s always like this). I just kept the paper after sending it that says “completed”. But my case status changed from “expedite request received” to “expedite request denied” the next day, no notification if or when they receive it. Hopefully yours and everyone requesting for expedite will get approved!

Oh okay, that's good to know. Like everything with USCIS rn, the missing email started to make me anxious haha. My status actually still just says "case received", but in the case history the expedite request is listed. But I'll let y'all know if I get a status update!! Sorry to hear yours was denied:(

Silly question. When you faxed the documents to USCIS did you mention receipt number or anything else on all the documents to ensure they are all part of the same request?
