where does it say "unexpired ?

https://www.uscis.gov/i-9-central/form-i-9-acceptable-documents under list B

" Employees may present one of the following unexpired List B documents:"

But as @GG10  point out USCIS put out special policy about using expired document in list B is acceptable

 https://www.uscis.gov/i-9-central/form-i-9-related-news/temporary-policies-related-to-covid-19

So you are right, using expired document under list B is acceptable now

Bahh.. For a moment I thought that they were going to mass aprove EADs today.. The waiting is overwhelming it's been 6 months since I filed.

And let me guess, now the estimated times are so high that no case will be considered to be taking longer than expected? 😕

Yes I remember one time hearing an USCIS official testify before congress and he was proud that USCIS did not have many cases “outside of normal processing times”. This means it’s something they are proud to show and they are willing to do anything to keep that number low, such as increasing processing times when needed. I submitted an ‘outside normal processing times’ request anyways as I don’t care anymore, I put August 1st 2017 as my PD so the system will allow it thru. Everyone should be contacting their congressmen, senators, ombudsman, send emails to USCIS and call them asking about their cases and if possible call in the morning to be called back by a Tier 2 operator. That’s all you can do without getting the courts involved.

you can still try to expedite without biometric, I request expedite request without biometric and USCIS granted the request and approved my I765 on July

Oh wow! This is a game changer, I’m going to call them tomorrow and let you guys know. Thank you!

@amyS Did you have any previous biometrics taken?

Yes its part of the administration plan. if you cant stop them, deny and delay so one gets frustrated and leave the country.

When congress updated immigration law in year 2000 they clearly stated that USCIS should process all applications in 180 days of filings. After 20 years, USCIS has become nothing but backlogs.  Just look at this example in what world is 73 months processing time legal.  The processing times below are completely bogus. They are hiding behind them and telling people that yeah look at the processing time and you dont meet the criteria to process your application. Complete bogus and criminal organization if you ask me.

The only solution is go to COURT. None of the others work.

@amyS Did you have any previous biometrics taken?

What reason can one give for an expedite if we don't have a job offer? If financial hardship what kind of proof do we have to give and would it affect our green card process?

March 24th filer here. Wish me luck folks, I have my biometrics tomorrow. Was very excited, before my landlord served me with eviction papers last evening, for no fault. I have been living in US for 5 years before I lost my job in September 2019 as my employer messed up my work visa extension. We managed to survive in California Bay Area with my wife's (US Citizen) meagre salary but she lost her job due to Covid in April. I lost all my savings, including 401K and have a mountain of debt. We have moved to 4 different temporary housing since September 2019 due to our poor financial situation and in May 2020 we thought we finally found a place where the landlord understood our situation. We have been dealing with Covid and the delay in processing my AOS it has caused, but yesterday we were devastated to see eviction filed on us as we couldn't pay rent for august and claimed non-payment of rent citing eviction moratorium. Unfortunately we are on month to month lease, though we verbally agreed we could stay here until one of us find a job (we explained our situation to landlord  before signing the lease and were assured we could stay here until my EAD arrives). We don't know if the law is on our side as we can't afford an attorney. We have reached out to non profit orgs but haven't received any help yet. Processing delays from USCIS has put us in a situation of eviction and inability to defend our case. I hope such situation never occur to any immigrant or a sponsoring spouse. I still have faith in America and its judicial system and am gonna give my best to fight the eviction case but I sincerely hope USICS approves my EAD sooner so I can afford to continue my fight

Yeah but the approval is a list c item right and you also need a list b item from what I read...which i dont have. I cant even be put on my husbands account without photo id in my married name despite the fact I have ssn in married name and our marriage certificate.

Why can’t you use your foreign passport for List B? That’s what I used back when I first got here in the US and I didn’t have any US IDs.

The below didn’t state it must be US issued:

  • ID card issued by federal, state or local government agencies or entities, provided it contains a photograph or information such as name, date of birth, gender, height, eye color and address

Sigh . . about a month ago I applied to a job, thinking that our EAD would be approved by now. No EAD, and this morning woke up to a positive response from the job asking to move forward in the process. It's not my dream job or anything, but it pays well for the field and would really help us out. Salt to the wound, I guess.

10/23/20 -- Biometrics applied to all cases (I-485/I-765/I-131)

10/27/20 -- Case ready to be scheduled for an interview (location unknown 😅)
