February 2020 AOS Filers

For those of us who are adjusting from a k1 visa, have the usc spouses received the stimulus payment? Did the immigrant spouses have a ssn at the time?

I'm asking because my husband never received his stimulus check, government website says that he wasn't issued one but doesn't give any explanation as to why, and when going over the requirements to qualify the only thing that stands out to us is that at the time the legislation was passed I had applied for ssn but not yet received it. The rules for the stimulus check exclude anyone living in a household with someone without ssn, but seeing how so many dead people received stimulus payments I would have expected them not to be completely up to date about me having moved in in February. But since no check ever materialized I'm now wondering if this is the reason and I just cost my husband his stimulus check on top of not being allowed to contribute any income to the household since half a year. Please give me some hope and tell me that you guys were in a similar situation and the usc spouses still received their stimulus checks...

That's an interesting question. 

 

My husband (US citizen) and I filed our 2019 taxes together in January, but I never received check, he did though. I have SSN. 

I think they used information from my husband's 2018 taxes (we didn't file together), because they sent check to our old address. We were lucky to have a very kind landlord, he let us to take a check from our old mailbox. ;)

Thanks for advice guys. I have a PDF copy of it but it says COPY in a big watermark. Will they let us in with that?

When I made my appointment through the phone with Tire 2 officer, he said I can print the notice out (with copy watermark) and bring it to the appointment. I did received the paper notice in the mailbox 7days after I made the appointment though

Not my personal experience but over the course of ASC re-opening, a couple of folks in this group were able to get through re-scheduling via Tier 2. I believe this is dependent on ASC whether they allow that or not. In my case, all re-scheduling were only done through the ASC and so Tier 2 was not able to do anything except tell us if any re-scheduled appointment went through already.

Yes, you can definitely do this and this is also what I did. I have two sets of lawyers. One for my immigrant visa and one from my company for my non-immigrant work visa. I had made both sides aware of my situation and they were able to tell me that I could file an extension of stay via my non-immigrant visa while my FB AOS is also pending. So that is what I did. It does not impact your AOS. Of course, your extension will depend on whether you are in fact eligible — in my case, my MPS (maximum physical stay) is not until next year so an EOS is warranted.

 

When you file an extension of stay, you are guaranteed the 240-day Ext rule which will allow you to work 240 more days after your current visa expires as long as the extension was filed before expiration.

Biometrics appt was April 4th but was canceled. They used my old fingerprints that was in their file. On April 8th, fingerprints was applied to my case for I 765. I applied for AP, no update since March 25th, i.e on March 25th fingerprints has been applied to your case for AP.

So, we just got off the phone with a Tier 2 officer, roughly 9h after talking to the customer rep this morning.

The officer we talked to was very nice and understanding, but was not able to help us any more than checking if I'd been scheduled yet (which I still haven't). When we asked if we could speak with a Tier 2 supervisor, she was not fighting us on that at all. She said she understood that this was a tough situation and that she of course wanted us to get all the help and answers we could get.

Overall it was a very positive experience, even if she couldn't share any positive updates with us. It's just nice when you don't have to fight with them to get help, and instead are talking to a human who understands the situation and seems to genuinely care. 

 

So I just wanted to share the positive experience with y'all. Especially since we all have had our fair share of stressful interactions with immigration officers, to the point where I get legit scared when I see their callback number pop up on my phone...😅

 

Oh, and I wanted to ask those of you who have spoken to a Tier 2 supervisor, like @James120383, if you remember how long you waited for the callback? The Tier 2 officer told us it could take up to five business days, so I'm just trying to prepare mentally. (low-key hoping it'll be sooner than that)

This is amazing and the first I have seen of this working!  What did you say that you think made the difference?  Urgent? Emergency?  Just being nice?  We need to copy you because Monday is really getting to be the last day ...

I just received call from officer, she fixed my email address and she provided me with a number of my request, she told me that I should get an answer in 15 business days, she says that my case looks very clean, and that she hopes that everything’s gonna be fine. The new thing that she told me and I did not know about is that all petitions are connected so if you get RFE for  Example I 765 or advance parole, your I 485 is on hold too.

i was transferred immediately. so dont know about the wait time

I told them that my ASC is open since 07/27.. and I has seen on many websites forums that they are sending appointment letters to people that has filled after me, and I that I was getting anxious cause I have wait for so long and i even cant have my driver license without my EAD and i was scared to go outside and be deported hahahahaha.. But I think it works, he just asked me some minutes and then he come back and told me ur appointment will be on 08/24

Unfortunately not all of us get nice reps like this.  Powerless and frustrated is what the Feb filers can feel.  So far Level 2 folks repeat the same rubbish. you have to wait 90 days.  iam like iam waiting for 7 months. how does that not get to you.

I feel u.. most reps just repeat the some other are so rude, I think we just have to try and try until they give us the answer we are willing to receive
