Might as well try it

I just sent them an email. The TRO has been extended to Aug 24 and we are covered by the order as part of the putative class members:

All aliens who reside in the United States and have submitted an Application for Employment Authorization that has been approved by USCIS, but who have not received an EAD.

Please keep us updated how it goes. I was thinking of submitting one too (ead approved 7/7) but I got my biometrics appointment for Monday 8/17 and am scared not to slow it down or something , so wanted to wait and maybe do it after If the card doesn’t get produced and shipped fast. (Not sure if this is how it works) My employer is still waiting and hoping I can start by 9/1.

Will do. My I-765 also goes out of processing time on Monday so I’m planning on doing an expedite request by then as well.

I've already chatted with Emma 3 times today, and am currently on hold for the 2nd call with USCIS. Trying different tactics to get them to actually help me.

@mat2291 my case will move outside normal processing times on Friday of next week. Do you think requesting an expedite will actually work? I keep reading it will be denied if you don't have your biometrics yet? Or are you hoping the request may be accepted due to the lawsuit?

An expedite is different than a service request. A service request can be placed regardless. Don't hope for much though- I had one placed last month and still just says it hasn't been picked up though.

Haha, yeah I have had a service request open since mid July as well... And they opened another one today, I think? But like I wonder if requesting to expedite a case without biometrics does anything or if it just will automatically be denied due to missing biometrics?

I believe an expedite will be denied, unfortunately.

hey all...so randomness today...so when I arrived in nov i applied quickly for a ssn in my maiden name under the impression that once I got my ead i would change name on it using that... Today i got an updated ssn with my married name on it out of no where? Approved ead without bio 7/7/20 (no card yet or rescheduled bio) ...what could this mean? That they're looking at my case or?

You probably checked the box on the EAD form to get a SSC issued. Since your EAD was approved, they sent the application to SSA and you got the new card.

I tried to expedite my EAD in July. It was denied due to no biometrics. I was hoping to get it approved because I saw people tried it and they actually got approved, but not me lol.

WELL, REALLY NOT SURE WHERE TO GO FROM HERE.

I don't think I will ever forgive myself for not walking into every single ASC office in the area in March.  Our March biometrics apt was three days after we got the biometrics appointment in the mail. And I got lazy and didn't walk us into one in those three days before our scheduled appointment.  It's only a couple days, what could change?  And then the first shutdown.  TWO DAYS before our appointment.  So no appointment.  And then February filers get screwed because our "reschedules" are done after the "new schedules" of May, June July filers.

And then every day talking to tier 2 or well-meaning tier 1 who reads from a script, or our Congressional office, or to the wall.

Pavlovian dogs; we sprint to the mailbox at the first sound of the postman.  For weeks.

And now, August 13.  Zero.  Zip.  Zilch.  And Congress recesses for August without and agreement, so USCIS furloughs start in two weeks.  Even if her biometrics appoointment comes in the mail next week, it will be for a date AFTER the ASC offices shut down again.

No job.  She can't see her only nephew who now is a year old.  No seeing her 76 year old dad.

Forlorn.  Dejected.  Pounded to the earth and trampled.  Done fighting.  Crushed and just over it.

I feel you and I am so sorry, you two are in this situation. I didn't walk in in March either because of a small cut in my thumb. I am still so mad at myself for not just trying. But also who thought they'd shut down in the middle of the week?

I hope you will get appointment before the end of the month. But chances get slimmer by the day. It sucks
