Hello, I'm new here and so happy to have found this site. So much great info!  My husband is from Guatemala and has lived here since he was 7.  His brother has DACA but  my husband was a few months too old. We applied for the i-212 waive, our lawyer warned us they were backed up and could take 2 years but we were approved in a little over  3 months! We were called in for a marriage interview a few weeks after applying for the waiver. Our lawyer had originally said that it wouldn't be necessary because it was so obvious our marriage was real but they still wanted to see us. She also said there was a chance my husband could be arrested at the interview but that wasn't likely in NY. Everything went well and our marriage was deemed real.

Today we turned in all of our documents for the I-601A Waiver.  Lawyer thinks we have a good case as both of our children are considered "special needs" in school and one is on the Autism spectrum. l have multiple medical diagnosis of my own that need frequent Dr follow ups and expensive medication. I got IEP plans from the school, Letters from my specialists and my sons. Also personal letters from everyone we know. Fingers crossed its enough!

We were told 8-10 month wait for approval and bout a year and a half for the whole thing to be done (If everything goes according to plan).  I'm hoping we get suprised with a quick approval just like we did with the other waiver.  Has anyone else had that experience? Anyone specifically from Guatemala?

Why did you need the I 212?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Sounds a very complicated case, good that you have a Lawyer involved.
