hi there!

I filed I-130 to VSC in Setemper 2006 for my wife. Recived the first NOA1. I apllied as a LPR(Legal Permanent Resident) because my N-400 was stuck in the FBI name check for more than three years. I filed a lawsuit in Feb 2007 and the name check got cleared in a month. I became a US Citizen last month. I called the customer service and put a service request to VSC to upgrade the petition. I also wrote a letter to VSC to request an update, giving them a copy of my Nataurlization certificate and I-130 recipt notice. Still waiting for their reply. Now, I am hearing from some people on this forum that their I-130 pettions are stuck because of a Name checks. I have USCIS Interoffice Memo regarding FBI name check that expalins the process. This memo also tells which type of applications have to go through the Name Check procedure. I do not see the I-130 there. If u want, I can post this Memo.

Can u please tell me if USCIS is doing Name check on I-130 or Not. I fear I will be stuck again. And, if they are doing it, are they doing for both a petitioner or benficiery or both. Please explain. Thank you for your help!!! regards, kim
