Not sure if I’m in the right place so please bear with me.  Ok so my situation is as follows.  My wife came to the U.S. from Thailand in June 2018 on a k1 visa and we married in August 2018.  She has her green card now. She has a 10 year old daughter that we want to bring here also.  The daughter wasn’t included on the k1 visa application.  My questions are what visa would we use to bring her here and what is a realistic timeline from start to visa in hand.

Well you can petition her to immigrate as a step parent.

 

When you say not included, presumably she was mentioned as children need to be declared immigrating or not.

Yes she was mentioned as children but not immigrating at that time.

Ok if I petition as a step parent what document do I use and what is the realistic time from start to finish?

She has a paper saying she has custody but the fathers name is on the birth certificate and the daughters last name is that of the father.  They were never legally married and the daughter has always lived with my wife’s mom.  That’s the reason we didn’t include her on the k1 visa.  I was sure that the father had to sign off on her leaving the country because of the birth certificate but now I’m not sure.

Sounds like you need a Thai Family Lawyer to sort things out.
