passport style photos for k1 petition i-129 form

Hi,

 

will they return my application if by the time they receive the petition, the photos are a few days over the 30 days? what about if they receive it on day that the photos are 30 days old?

also do i need to submit beneficiary birth certificate at this time or at a later stage?

No, they say the 30 days window to imply that you want to submit passport style pictures that show you as recently as possible.  For example, if you are a person that dyes her hair every two weeks with different colors, then it would make a difference because within a two-week period you look like two different people.  But, if they are within the 30 days and they show you as you continue to be, I don't see why they would return them (at least in my opinion).

For the beneficiary, it is best to include it from the beginning but I believe it is not a requirement.  The requirement is for the USC (petitioner) to prove his or her citizenship.  However, the K1 person (beneficiary) WILL need it at the time of the interview at the embassy.
