I understand that when getting a DL, your expiration sometimes is the same as your green card/ EAD/ visa.

So I have the impression that, when I go renewing my DL, they would ask for proof of my legal status - which will be expired GC+ extension letter.

My extension letter is expiring in 6 months...... (OCT.)

My passport is also expired and I cannot get a new one.

And I am also moving twice (2 different states) this year for work reasons.

 

My DL is my only form of ID right now until my I-751 goes through, and my GC comes (hopefully.)

Which means I need to get my DL renewed to Real ID before OCT, which is the same month my extension letter expires on......

 

Question:

1) When on a 18-mo extension, does the DL you get also expires on the same date?

2) Would expired GC+ extension letter be enough for proof of legal status?

3) Or when I renew in the same state (CA,) I won't have to prove residence again?

4) Or should I apply as a new resident in WA?

5) Any suggestions on what the best way is to go about this?

1) Yes. They expire the same date as your legal status

2) Expired GC + Extension letter are proof of legal status as long as they are valid. Once the extension expire you're out of proof not out of legal status

3)Some states like mine (Pennsylvania), you have to prove your legal status every time you renew your DL. Idk about CA to be honest

5) My suggestion is to call the 800 number and schedule an info pass to get the stamp within 30 days of your extension letter expiration. With that stamp you have a proof of status and you can renew your DL

I don't have a real ID in California yet but I got my driver's license when I only had my EAD and it expires long after even my 2-year green card expires, I think they made it valid for 3 or 4 years. I'm really curious how this real ID thing is going to work now.

Unfortunately, my foreign passport has expired and there is no way for me to get a new one. So I am not able to get a stamp.

Is the stamp usually valid for 1 year? So when people apply for a Real ID with a stamp, it's also valid for only 1 year?

 

Do you know whether the DL would expire with extension letter even though my legal status doesn't end with the letter?

I honestly Idk about CA. I know in PA it will expire with the extension letter. About the passport expiring, you still can get the stamp outside the passport on a form they will provide which will have your photo and the stamp

So you don't live in CA anymore? I would assume you need an ID from the state you live in, but I've only ever lived in the one state so I'm not sure.

 

My last DL/REAL ID expired 6 months after my 2-year GC. I got a notice of renewal in the mail a few months before expiration so I just replied to that and I got my new DL/REAL ID in the mail a few weeks later. It's valid for 5 years. If you get that renewal notice, I would try doing it that way. But then again, if you don't live in CA anymore you probably won't get it.

We got lucky in CA.  The real ID should expire when the legal status expires, and my husband's first driver's license reflected that.  When he went in with the extension letter, they gave him the full 5 year DL.

 

Also in CA at least, you don't have to pay a second fee if you renew because your status was extended.

I believe you can still get a new one, but I'm unsure how I think you have to go to your countries embassy in the US.

Each state differs. My husband got his DL when he got his first green card in 2016 and the expiration is 2022 when the green card expired in 2018. I don't know if the Real ID will just line up with the current green card though, but I would be very curious if the state will allow the use of the I-797 to extend the green card status.

When my husband went for his green card the first time while AOSing, even though Texas lists a I-797 for pending AOS application as proof of residency, the lady at the DMV said she couldn't enter the I-797, it either had to be a I-515 (stamp), green card, or EAD.
