FEBRUARY 2020 I-129F K-1 FILERS

Technically speaking, an RFE is a written request for more information and documentation that USCIS mails out if they believe that they don’t yet have enough evidence to approve or deny a given application. An RFE normally is a minor item and should not be looked at like it's a denial but an opportunity for you to complete your application. It's just a step that they must take and once they have your information and it meets their approval then you should be seeing your NOA2.

Once you get your RFE, read over very carefully as you only have one chance to reply accurately without causing undue harm. Once you know FROM THE RFE what it is set out to correct and to include "everything" they are asking for. Then reread the RFE to ensure you are compliant. Make copies of everything for your record and send back using their instructions which are contained within the RFE. If the RFE requires a signature, PLEASE don't forget this. Include the original RFE letter along with a cover letter explaining what you are including in your reply. Like a checklist format. Once received at USCIS your case will begin adjudication where the agent had left off. No one can tell you how long it will take so be patient.

Thank you @Greenbaum I feel a bit more at ease but I’m naturally an anxious person so I can’t help but stress in these times ☺️ Still haven’t gotten the letter in the mail yet but would this also be a good time to include in the cover letter that we have been apart for more than a year now and it’s taking a toll on us and our relationship? I doubt they care but do you think it could help our case... I haven’t seen my fiancé in over a year and visiting is risky because of Covid restrictions. I know they won’t expedite just because I miss him but is it pointless and silly to tell USCIS this? Thank you again

Your visa application will process just the same with or without a letter. Save the paper and let things progress as they will. The only way to move faster is if you are in the military and are about to deploy or that you have a good reason. Missing your love one is not on their list. Sorry, you'll have to stick it out. Good luck and stay engaged.

Timeline

So I finally got the letter in the mail for RFE and is what I suspected. It was for the two years in person meeting requirement. I had a weak spot because i couldn’t get any pictures with my fiancé when we met so I provided passport stamps, boarding pass, letter from my dad notarized saying we met and what’s app call logs and screenshots with date and time showing we were meeting in person. And I got this in the mail asking for more evidence including stuff I sent or photos or more letters. I am confused and upset and don’t know what else to send. More letters from friends and family? Passport stamp and boarding and WhatsApp messages again? I am so sad we didn’t have any pictures together an I’m scared I’ll get denied after waiting 7 months.

Wow I'm sorry to hear this. I have seen many people on here say that photos are just secondary evidence and are not that supportive. This is the first RFE I have seen that specifically mentioned lack of photos. 

Found love, thought I wanted this path, two years later realized my partner was not worth all the stress 😁

At first thought I was thinking they were being to tough on you but then I thought, in this day in age how could you or the family have not taken at least one picture? I only say this because I'm guessing the agent thought the same thing.

I'm going to repeat myself as this is a lot to respond to and you don't want to make a mistake by leaving something that the requested out of the return response.

After having my Congressman intervene multiple times, I received my NOA2 today. I'm guessing USCIS wasn't happy with me.  They told my congressman's rep they were processing a way early time frame than they actually were two different times, the second time frame( Feb 5th )was when they were clearly into late Feb. They tried to make me look like I was crazy in their response to my congressman's immigration rep. (He was great to work with!)  LOL their own app proved they were not being honest and I showed all 20 cases around mine that were approved (Feb 21st NOA1) so their date was statistically impossible. I told my rep that deceiving a member of congress was very serious and he agreed. I'm sure his next email wasn't as kind to USCIS as the others had been. Amazingly (sarcasm) I was approved a few days later. 🙂 I also had a strange hunch I wasn't  going to get an RFE unless they absolutely had no choice like a left out question. The old go to "not enough proof of meeting" opinion based RFE wasn't going to fly this time. Yes this outcome is all conjecture but everyone here forgets that government works for us, including USCIS.

USCIS doesn't have an app. You are using an app provided by a third party. Your timeline matches what USCIS populates on their website for timeline case adjudication. So, having a congressional "rep" step in on your case may or may not have helped. They are adjudicating February cases and with the short staffing and other factors, that we are not seeing, could have influenced USCIS in completing your file to NOA2. This is just what I have seen over the six years here reading and help others with their questions.

 

In the end I am glad you received your NOA2. Exciting times are ahead. This is the stage now that you control how fast you move forward. Good luck and stay engaged.
