In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

True, and we haven't sent any W2s with either of our petitions/applications. Not needed. Only tax transcripts, and we file jointly.

They will be permitted to provide additional evidence that the public charge inadmissibility can be overcome (typically via a co/joint sponsor, but possibly by a new I-134/I-864 from the sponsor due to a material change in circumstances like a new or second job).

Entered the US with my CR1 today via Detroit Wayne (DTW), had absolutely no questions relating to public charge.

How is that a change?  Household size has always been on the forms.

My husband and I got married in June of last year and plan on starting the visa process some time this year.
 

I’m concerned about how the public charge laws from USCIS that started in October 2019 will possibly effect our case.

 

For a potential public charge determination, will the government be looking at my past use of non-cash benefits, as I am the American citizen spouse/petitioner? I’m 22 and my partial Medicaid ran out this month (I am NOT re-applying) and I was in section 8 housing program with my mother until October of last year, and was had food stamps for 3-6 months in the beginning of 2019.

I now have a salary job making $29,000 a year (have been at this job for 6months now) and own my house and car so I’m hoping this will outweigh the negatives...

 

 

My second concern, my husband has had an unstable job history and doesn’t have any savings as of now, although we plan on saving up as much as possible before he comes here. His work history is a lot of 3 months of work here and there. 
He lives in Japan and was concerned that full time employment would effect us being able to visit eachother since he wouldn’t be able to take time off of work... he couldn’t afford to go to college. But he did complete highschool. 
He doesn’t have any debt or anything like that so I think that would be a plus though...


also, his name is on the deed to our house, along with mine, so I don’t know if that could help?

 

Can someone please give me some advice and/or more information about the new laws in effect because I’m very concerned.

Also, I have been getting medical assistance through a charity type organization, they are not government funded. I believe that this assistance also ran out this month, but I do not have any medical insurance now. Should I go ahead and get medical insurance for myself (petitioner)?

 

My husband has health insurance in Japan and I heard that he would need to get health insurance here before entering the United States as well...

Hey guys,

My fiance and I will shortly be getting married and filing for an AOS. I've been reading a lot on this public charge rule, but not sure if I completely understand it.

From my understanding, this is just an additional factor the officer can consider, and pretty much just uses factors if my soon-to-be wife is using any public benefits right now?

She doesn't even have a SSN, and definitely isn't receiving any benefits from the US, and I've never received any myself-- so I'm guessing this won't be applicable to us?

 

Sorry if this is a dumb question, just kind of confused even after reading some articles about it.
