Hi,

I am about to submit I-130 online for adjustment of status (already in the US, living with American citizen spouse). However, I am wondering when I should submit the I-485 forms, including travel doc and working permit. I wish to have them processed the fastest and efficient way. Any take on the steps of submission in this case?

- Feb 22 2020 - Mailed Application (I-130, I-845....) to Chicago

- April 22 2020 - NOA 1

- June 1 2020 - RFE for I-944

- June 24 2020 - Replied to RFE

- Oct 25 2020 - Fingerprint done

- Nov 9 2020 - Case ready to be scheduled for interview

I suggest you submit all of them together a long with the I-130. Don’t forget you need to submit I-130A also.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Not sure how the NOA2 for electronic filing works. But filing the I-485 requires either filing the I-130 at the same time or providing a copy of the NOA1 with it. It may be simpler to just mail them together instead of filing online.

Hi,

I have thought about this, even asked about it on this forum. We have been married for more than 5 years ago, while I was away for work. I don't need a visa to come to US, as I am from a visa-exempt country (but have visitor status as far as I know), so I thought the rule cited below wouldn't applied in my case...

Am I wrong?

If you entered the US as a non-immigrant, the guide applies to you.  Are currently inside the US?

I didn't quote any section.  I was merely posting a link to the entire guide.  That section just happens to be at the top of the guide.   The guide explains concurrent filing....

It is fraud to use a tourist visa to come to the US with intent to stay/file for AOS.

No........You can not enter the US with a tourist visa with the intent to stay and adjust status....that is visa fraud.  It can result in severe penalties...
