Orangesapples,

I really appreciate you for your replies,  I think I am getting somewhere with these ideas on this community. We just added myself to the internet and gas bills today. Looking at the time frame the RFE was issued, do you think it is a good idea to add those to the documents I will submit considering the deadline April 11 of the RFE? Thanks

we have the same issues, we talk with different lawyer and to be honest they all have different opinion, some said it will look worst and some said it will look better.

Hi Sukie,

Thank you very much, we don't have library cards and gym membership cards together. We do not even have. We might go get the library cards but don't u think it may look somehow based on when the rfe was issued. The deadline to respond to the rfe is april 11th. I will be glad to hear from u. Thanks

Those were just some suggestions, Wiseman.  Send what you have.

@Wiseman239295, do either of you have retirement accounts at work? Like 401ks? Or do you have retirement accounts at all, like IRAs? We had similar issues showing "joint living" because I had to open stuff in one state before my husband could join me, and then we moved into an apartment where all utilities are covered, so nothing in our name.

Here's a list of what I provided from our cover letter, with identifying info removed. My husband's ROC was approved with the evidence below, and there was no interview:

·       A copy of the front and back of Green Card

·       Copy of the front page of our car insurance policy

·       Copies of a 1095-C from, a 1095-A from [state], and a 1095-A from [state], showing my husband as a covered individual on my health insurance policies from work and later the healthcare exchanges of the states we have lived in.

·       A current bill from our current insurer, ___ , showing expenses for both of us on the same bill

·       A screenshot of our family Health Savings Account, showing my husband as the sole beneficiary as well as a copy of our debit cards from the account

·       A screenshot of my 401(k) showing my husband as the sole beneficiary

·       A voided check from our joint bank account

·       A copy showing the backs and fronts of credit cards from a shared credit card account

·       A copy of our joint federal tax return for 2016

·       A copy of our joint federal tax return for 2017

·       Screenshots of my personal Facebook page showing posts from our first and second anniversaries (I made my page is publicly accessible if you need to verify)

·       An invitation letter for [husband] to perform at an event at my alma mater and a copy of our reservation for that stay

·       Flight reservations for our mutual friends’ wedding. We misplaced the original invitation but I included an email conversation showing the “Save the date”

·       Flight reservations to visit our friends’ vacation home in

·       Flight reservations to visit [state] before our move here

·       Flight reservations, hotel reservations, a copy of husband’s Schengen visa, EU entry stamps on both of our passports, to visit _____ for the _____ Festival

·       Pictures of us together

I also included the following explanation (this is verbatim with identifying info removed):

  • I wanted to also clarify that joint utility accounts are not included in our evidence because I had to move to [state] to start a new job before my husband had been approved for his CR-1, so all of the accounts were set up before he had a Social Security number or permission to be in the US. Since we’ve moved, we have been living in a rental where utilities are included in the price, so all internet, electricity, water, gas, and trash collection bills are in our landlord’s name. Additionally, our cell phones are on a family plan with the rest of my immediate family, so we don’t have a cell phone bill addressed to us.

So, we were missing a lot of the stuff you were but it turned out OK. Are either of you active on social media? Do you have anniversary posts, wedding posts, etc., with a lot of likes and comments? Every time we submit something I make screenshots of posts like that with all the comments expanded (which shows that your marriage is known about by lots of people). Do you have pictures together at functions like weddings? Personal mail addressed to both of you (like invitations, thank you cards, Christmas cards, etc.)?

I disagree with the suggestion to make changes (like refinancing) once you've already gotten an RFE.  I think your strongest evidence is to supplement with what evidence already exists.  It looks less convincing to do something after an RFE and then provide it as evidence.

Read the RFE again. Mine said the same thing but when I read it again I noticed they listed what they had on file. All of that was from the AOS. All my ROC evidence went missing. I had copies and sent those and all was well after that. Also make sure you show that both you and your wife are at the same address, include copies of both drivers licenses not just yours.

That's a really good point about checking what the RFE said, and good eye for catching and realizing that they'd just not even looked at what you sent for your ROC.

What is your service center?

I think you should submit 2018 and 2019 tax returns, get dental insurance and yes, agree about the wills.

My service center is Nebraska. Sure, I will submit all those and see what I will do about the wills. I do not want a situation that look like I did the wills bcos I was given an RFE. Thanks..

Just FYI,

https://www.forbes.com/sites/alyyale/2020/01/30/mortgage-rates-near-3-year-low-94-million-homeowners-could-save-272-per-month/

As long as you have good credit, refinancing now is a great decision even independent of immigration but it might help with your ROC anyway.

Not really that I have bad credit though, but i had enrolled in school for my master's degree and I am paying monthly installment plan. It will be too hard for me to think about refinancing now bcos I don't have much money in my bank account right now. I think I will put it in writing why we don't have mortgage or lease together (like I said earlier the mortgage is on her late husband name and hers...and she hasn't changed it.). I don't know how to put it in verbatim for now.

It's up to you. BTW, the closing costs could be added to your rate. I'm not saying it's definitely the right thing for you now, just giving you ideas.

Hello everyone,

In respect to the RFE given to me to prove that I entered the marriage in good faith, I had put up copies of documents to submit. These are the documents I will be sending very soon.

1. AT &T prepaid account history for both of us showing that we are under the same bundle. Since we do auto pay and prepaid AT&T does not provide statements.

2. Transaction details printed from my bank account that show AT&T telephone services provider as home and utilities from 2018 to 2020. I was able to generate these because the auto pay come directly from my bank account. No names show the amounts showed.

3. Utility bills for light both in our names and address from 2018 to 2020.

4. Bank statements jointly showing that mortgage, energy, water bills come out from our joint accounts; even though our names and address are just on the light bill. Mortgage and some other bills already have my spouse name and her deceased husband before we got married. We succeeded only on adding my name to the light bill then. But I ensured that I highlighted the mortgage, water, light bills in the joint bank account statements.

5. Greeting cards from me to my spouse and from my spouse to me on anniversary,  birthday, Father's Day, valentine's day.

6. Greeting cards from friends and family.

7. Copy that shows me as her emergency contact and access to her medical record.

8. Copy that shows my wife as an emergency contact from my school, employer and hospital to discuss  my medical record.

9. Mail from hospital addressing to my wife to send spouse paystub from my employer.

10. Tax return summary for the year 2018-2019 jointly filed. I also requested for the 2018 transcripts form IRS.  I have already submitted 2016-2017 initially.

11. My 1098-T and W-2 showing my name and address from my employers from 2017 - 2019

12. Last will and testament, durable power of Attorney,  trust and estate planning for both of us. We started planning the will since 2018 but the will needs to be updated, notarized and signed.

13. Void checks both in our names and same address used to pay for property tax in our county.

14. Mails from IRS addressed to both of us for incorrect refund and refund.

15. Copy of credit cards showing both of us names and credit card number since we have the same account number.

16. Photos with family and friends and my spouse with names I could name and little descriptions.

17. Copies of triple A (AAA) documents showing both of us as members since 2017 up to date.

18. Copies of membership cards of AAA for me and my spouse showing the same membership number since 2017 up to date.

19. Copies of life insurance letters that indicated we applied in 2018 for both of us and that our files were received.  We had medicals done but could not finish with the process because I haven't got my green card.

20. Copy of a basic life insurance from.my employer indicating my wife and my children as beneficiaries.

21. Medical bills in my name that show the address I live

22. State farm insurance cards that covered our cars showing our names.

23.Copy of a temporary auto identification card from state farm insurance in both our names.

23. Statement from state farm automobile insurance company in both our names and cars covered from 2018 - 2020.

24. Copy of current health insurance provider by my employer.

25. Copies of Previous health insurance both in our names.

26. Employer provided health insurance offer and coverage to file for 2019 tax both in our names and address.

27. Copies of my previous and current driver's licenses, also copy of my wife driver's license showing the same address.

28. Emails from friends and family wishing us Valentine's and anniversary.

29.  A bunch of WhatsApp messages showing our conversations .

30. Saving account bank statements showing transactions pages in both our names and address from 2018- 2020.

31. Checking account bank statements with transaction pages in both our names and address from 2018-2020.

32. Copy of a document from my employer for confirming my wife as a beneficiary for incentive investment plan or retirement plan.

33. Copies of documents from my employer confirming both of us covered for medical benefit.

34. Letter addressed to both of us from IRS for a refund check sent to them in both our names and same address.

35. Copy of letter addressed to both of us from COBRA to cover our health and welfare benefit program.

36. Copy of document from my employer that shows my spouse as a primary beneficiary to my basic life insurance.

These are the documents that I have put together, please I will appreciate suggestions and advise from you guys. Thanks.
