hey guys, my situation is very complicated:

 

I received my conditional green card on nov 1st  2018.

 

since then, I traveled outside the US ( between nov 2018 and may 2019 )

 

Fist trip - ( vacation  ) : 7 days

Second trip  ( vacation ) :18 days

Third trip ( vacation ) : 9 days

Fourth trip ( vacation ) : 10 days

total: 44 days

 

but then on May 2019 because of a serious medical condition I had to come to my country. And Im still here, I plan to go to the US on April.

So add more 10-11 months outside the US ......:

 

My plan is to stay in the US for 2 months, and then, in June go overseas again for more 2 months ( 60 days ).....

 

So, if everything works fine I would be in the US again in September to file for removal of conditions ( 2 months before my green card expires )

 

My question is:

 

1- what are the chances CBP gonna confiscate my green card because of the fact that I am outside of the country for almost a year? 

 

2- If everything works fine is there any chance, that, if I stay in the US for 2 months, and then, go overseas again for more 2 months when I return, I keep my green card?

 

3- If they confiscate my green card and issue me a NTA ( notice to appear ) how Im gonna file for Removal of conditions without the green card? ( I wanna do that in September after I arrive in America after the 2-months trip )

 

 

Guys, I know my case is complicated, but life happens and besides the fact that Im staying in my home country for a medical treatment, I have the opportunity to go to Europe in July for a 2-month course that is gonna be really important for my carrier ( Im a medical doctor in my country currently studying to get my US medical license and be able to work in America as a doctor )

 

I don't wanna lose my Green Card but life happens....by the way... me and my spouse gonna get a divorce when I arrive in the US on April. ( right now we have apartment leasing together, gonna file 2020 tax together, .....but my ROC would be with a waiver ( to get the things even more complicated ) 🤣🤣.....

 

Should I just stay in my country and forget the United States???? 😄

Zero chance keep it under a year.   Expect hearing a warning about being out over a year.

Until it expires.   Make sure you renew in time

 

Your time away isn't going to help you get citizenship quickly.

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Im not even considering citizenship anytime soon anymore.... just don’t wanna loose my green card
