Both have to be.  The company is a part 135 (non-scheduled) operation only authorized to operate VFR by the FAA.  I'm sure when the flight started, it WAS VMC, but as conditions deteriorated,  the pilot should have landed ASAP or returned, not try to continue flying.

 

Even though the pilot and the aircraft were instrument rated and instrument capable, it was a violation of the operator's certificate.  More importantly, and probably crucial as to the WHY the crash happened, he wasn't current or proficient in IFR flying.

The people I know fly for Airlines that certainly are IFR rated, if the Pilot pretty much solely flew for this company seems unlikely he would have had any need or case to use it.

Imagine learning how to drive a car at the age of 15, then never driving again until you were 45.  And suddenly finding yourself driving a car in downtown Atlanta (or Manila) traffic at rush hour.  Then multiply that by about 10.  That is something close to what that pilot was feeling right before he stopped flying.

I understand the issues, try driving down the main road here in a whiteout and then add another dimension. We do not know what he did, but sounds like he lost spacial orientation.

In your (very apropos) scenario, one can pull over and stop, hoping no one comes by and plows into you.  (Impossible to pull over to a cloud in a hoopty, however).  But yes, that transition from being able to see, and then blinding whiteness is pretty much the same thing.  Even better than my driving example.

 

It is very critical that when one loses visual contact that an IMMEDIATE transition to instruments is made, and 100% trust in them I'd implicit.  At his altitude, it was the only right call, and if he DID try for it, he delayed too long, sadly.

 

I say IF he tried to switch to instruments because I watched the radar video showing a last-ditch rapid climb, but saw somewhere else that he descended rapidly.  Not sure which is accurate.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
