My fiance now wife is here on K1 status. She is pregnant and we do not have any plans for her to seek employment any time in the near future. Our question is-do we need to submit her employment authorization to receive a green card? Once she receives her green card does she need an EAD to work or is the Green Card sufficient? Confusing I know but as we all know this entire process is confusing. Thank you for your help. Ron and Marlou

If she doesn't plan to work, she won't need an EAD, although many states won't give her a driver's license without and EAD or Green Card. You don't need an EAD to get the Green Card. You don't need an EAD after you have the Green Card

You are not required to file for EAD when filing for AOS, EAD is an interim benefit that allows work while waiting for green-card. And the Green-Card is work authorization, so no EAD is required to work when you do have a green-card.

We held off filing for EAD because we were seeing green-card approvals coming fairly quickly through our local office, and decided to apply for EAD if we were not seeing much movement on our case.

EAD is not needed for Green Card. A lot of people apply for EAD because they want to make sure they're able to work before they get their Green Card (since there's no guarantee when you'll get GC).

Just make sure to file for her GC before July 30th or else you'll have to pay a lot more for documents you don't seem to need (EAD and AP).

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!
