Tax question. Possible future issues?!

I am a US born citizen, and I have been living in Spain for almost 10 years and I got married in October 2019. I recently filed my taxes online and when I tried to file as married, "but filing seperately," (because obviously my partner isnt a citizen) but it requested that I enter a SSN for my partner. After trying to leave it blank, or changing it to all zeros it would not allow me to continue. At the time, I decided to file "single" because my partner doesnt have a SSN and has never lived in the USA. Now, I'm starting to wonder if I made a terrible mistake on my taxes, and  will have problems at the NVC. Any ideas?

You cannot file electronically as MFS if your spouse does not have a SSN or ITIN.  In addition, you cannot legally file as "single" since you are married. 

 

To file as "Married, Filing Separately", (when spouse does not have a SSN or ITIN) enter your spouse's name in the appropriate box......then hand write "NRA" in the box for your spouse's SSN.....then snail mail the return to the IRS.

 

You need to amend your return if you filed as single.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Tax filing status is an IRS issue, not an immigration issue.  I have not seen a single case where filing status was an issue at NVC or the interview.

Looking at the 2019 tax tables, it appears that the tax rates for "single" vs "Married Filing Separately" are the same....

I  used the TAXACT software to file my "single" status. When I went online to begin the amendment (I would then print it out and mail) the amount I had to pay shot up $500 according to the online platform. I am an independant contractor. Ill take a closer look again. Your help is great!

Hmmmm.....I'm not sure why there would be a difference...I'm interested in knowing why......Here's the 2019 tax tables, in case you want to take a look.

Thanks for that link, I was looking for it at the time. I see what you're saying! It shows that it would be the same ammount. TAXACT shows that the 1040x isnt available yet through them, so I will wait until it is and continue from there. Thanks again for all your help.

An independent contractor is self-employed to the IRS and pays self-employment tax in addition to income tax on their return. It is basically the way self-employed pay their share of Social Security and Medicare contributions since an employer is not withholding from a paycheck.  Also self-employed calculate the full contribution, whereas an employer pays half the tab for their employees’ Social Security and Medicare. 

That could be the difference, however one would think he did the Schedule C and SE the first time.

The standard deduction is for Single or Married filing separately is $12,200. Married filing jointly  is $24,400. Maybe that has something to do with it.

But the OP isn't filing joint.........He filed single, and he is amending his return to Married-Filing Separately.......
