Hi,

I need to take US Tourist visa for my niece, who is 8 years old.  Am in H1B. 

My Brother and his wife doesnt have US visa but I would like to get their kid (my niece) for short vacation trip.

Am currently in US and she is in India.. Is there any condition on who needs to accompany her to attend the visa interview? If so, please advise.

Also, is there anything that we need to take care of until i get her..

Why would she travel to the US without her parents?

There is nothing you can do to help her apply for or sponsor a visa for your niece.   Her parents would need to apply for it.

HI Jorgedig,

Actually my niece will travel with her grand-parents (my parents) from India to US, where I stay.  This is just for a 2 month vacation trip during her holidays and then she will be back to India for schooling again.. Her parents couldn't accompany her because they don't get leave from their job/schedule..

Hope you got your answer.. Do you have any tips/points for Visa interview and travel?

Do your parents have visas already?

Anyway one of her parents will accompany your niece to the interview and help her answer questions if necessary. 
 

Btw “is there anything that we need to take care of until i get her..” is strange wording to use if her grandparents will be flying with her.

Hi,

Yes, my parents have US visa.  But, both her parents don't have US visa.

My question is it mandatory that 1 parent/both her parents need to be with her for visa interview?  Or if her grand parents accompany her for the interview is that fine?  

Also, any critical questions that we need to take care during the Visa interview?

It is my understanding that it must be a parent or legal guardian. It almost sounds like you don’t want her parents there, which is kind of odd. 
 

B visa interview questions tend to be about returning home. For a young child traveling without parents there will likely be questions that ensure the safety of the child.

Well not sure there is any requirement and I can think of cases where Grandparents have take children to immigrant interviews. probably easier of Parents do it as otherwise you need to show Parental authorisation.

Well for India it’s implied (see below) , for other consulates I have seen they specifically say must be parent or legal guardian. 

 

  1. Child below 14 years of age must submit a photocopy of each parent’s passport biographic information page and valid U.S. visa (note that if parents do not hold U.S. visas, children are not eligible for the interview waiver).
  2. Accompanying Guardians/Parents can carry the child documents with one hard copy photograph as per US Visa Specification. For photo specification follow link.

Wonder what is meant by Guardian, I am pretty sure US and UK have different definitions, no idea about India and it is also used in an informal sense.

Well, whatever, all they will do is waste time if he sends the grandparents and they find they need parents and need to go again. Certainly the easiest way to ensure parents are on board and understand purpose of trip is to have them at the interview.

Totally agree, I think where I have seen this most is PI where the mother has gone and the children have been left with usually Grandparents to follow later.

HI,

Thanks all for your prompt and valuable responses..

For now, am sure at least one of my niece's parents will go to the visa interview with her.  But, am concerned if they raise any issue since both her parents don't have US visa and in that case, does her grand parents (who have US visa) should also accompany her..

I do not see any need for the Grandparents to go, not even sure they could.
