You only list assets like 401K, and bank accounts when you fall below 125% poverty line.

Poverty line is explained here: http://www.uscis.gov/files/form/I-864P.pdf Minimum depends on where you live, and number of dependents.

My income is way above the minimum so I kept it simple and For assets I did not list any, so I did not need to provide any asset data like bank statements, IRA or 401K ect.

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview

Remember if you do provide assets, you need to provide evidence, the more you list the more they can ask to see.

Thank you, YuAndDan for the prompt and detailed response. Currently I am just a full-time student living entirely on my scholarship, so I am not even sure if my "income" is salary (I do receive W-2 however). How about regular investments (non-retirement) like mutual funds?

Also, who is my employer? I am doing research for a professor - should my professor write the statement, or should my department write the statement?

Lastly, my school has gone entirely paperless, so it doesn't give pay stub anymore. In this case, what counts?

OK here is the deal, get a co-sponsor to help you, in many cases the consulate will accept just the co-sponsor for the K-1 visa type. The co-sponsor is just indicating that they will sponsor from time of entry to the USA until K-1 adjust status, at this time you can worry about sponsoring the immigrant, you will be primary sponsor, and you can get the help of someone willing to be a joint sponsor, or by that time your income situation may be able to support the immigrant.

Ursa,

If you are getting a W-2 there is an employer's name and tax ID number on that W-2.

Somewhere there is documentation of the payments made to you, and you have access to that documentation.

Your school should have an online site where you can log in and view your paycheck if it is entirely paperless. I would contact human resources and ask them these questions.

02/21/07 - I-129 NOA1

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/16/07 - Medical Examination

06/26/07 - Packet 3 SUBMITTED FINALLY!!!!

07/07/07 - Received pkt 4

07/22/07 - interview consular never bothered to show up for work.

07/29/07 - interview.
