Hi guys,

I'm holding a 2-years conditional green card(from K1 and AOS) with expiry date 09/10/21. As my mom living back my home country China got cancer and I'd like to take care of her for a while(not sure how long. Depends on her condition. Can be 3 months, 6 months even longer if possible). My question and concern is:

1. How long I can stay in China?

2. Will my stay in China impact my futurn application to remove condition from green card?

I appreciate for any insights and answers.

My wife is in the same situation.
1. You can stay in China for less than 6 months with no issues. More than 6 months but less than a year, you’ll still be good but expect more questions at the port of entry and you should be able to prove that US is still your permanent resident and not China. If you know you’ll staying more than a year, you should get a re-entry permit before you leave the US. Re-entry permit still does not guarantee your entry, you should be able to prove that you’ve not abandoned your residency.

2. If you follow number 1, your stay will not impact your removal of condition application but might impact your ability to naturalize if:

a. your total length of stay in China is 18 months or more within 3 years.
b. You stay in China for more than one year in a visit.
