IR2 bringing stepson to USA

Is there anyone from MYANMAR? I married US citizen 2 and half year ago and now I'm in US with my husband for over 1 year. We filed visa for my son and now the case is at NVC. I have some questions for embassy interview. I divorced my ex-husband (my son's father) in 2006 and he passed away before I remarried to my current husband. I have both certificate of divorced and death, but I heard people are saying that consular might ask permission letter from grand parents to allow my son to come to USA. That will not be easy for me to get since I lost contact with that side so long ago. Can someone share experience with me,please? I need to know those people who recently took embassy interview at US embassy Yangon, Myanmar, thanks in advance.

I assume the grandparents have custody of the child given that you stated you "lost contact with that side so long ago"? 

 

Your post is slightly confusing---presumably the grandparents know of your plans to immigrate the child if the child is under their care?

My son is almost 17 now and never had under taking care of his father side. I got divorced with his father since he was 3 and that was the last time for my son that he saw his father. After that no contact till the father died in 2017.

So who has legal custody of the child?  That's the important bit, but moot when he becomes an adult.

Yeah, worst case you wait a year and when he’s 18 he doesn’t need anyone’s permission (but still qualifies as ir2).

What do you mean, you “think” you have full custody? Surely the divorce agreement specifies whether you do or don’t?

In divorce agreement, it said " mother will be in charge of responsibility and caring of son" , and I'm the one who have been taking all responsibilities of my son till now. When I moved to US last year, my mother has been taking care of my son.

Unless the grandparents have legal rights to your son you only need the fathers death certificate.
