Third party interference caused a denial

Has anyone ever experienced a third party calling the embassy and lie to the embassy that directly influenced their decisions?

  Maybe in cases where the real wife got tired of waiting for the  hubby to get a visa with a new person so they could get to immigrate.

I have come across a few situations, not sure if it is very common.

What was said by the 3rd party that led to the denial? And was this third party an ex of the beneficiary?

Yes, yes and yes again. It was her ex who called and told the CO that they still were a couple and living in SD. When they are not a couple and are in court now.

The Embassy would never take a third-party report as fact. If it appeared at all credible, they would conduct an investigation before taking any action.  How do you know what the Embassy was told and by whom?

So next week s the case.. our lawyer expects a favorable outcome. Then we refile.

So apparently his mom was so disgusted with her sons actions she told my fiancé what happened and what he said

He said that they were still together. Even though he is remarried and lives in Spain.

Ok. I am going to just put it out there.... your relationship seems to come with a lot of baggage. Just going by your post history, here is what is going on...

- Your fiance had a previous person (we still don't know if it was a spouse or fiance) who petitioned for her

- The ex foreigner, for some reason, did not go through with the petition and notified their embassy of your fiance being a fraud

- Your fiance is in on-going legal proceedings with her ex for sole custody of their daughter.

- You filed a petition for your fiance, but a few months ago wanted to cancel because you though you were being used by her to get a green card

 

I agree with @jan22, that fraud accusations are not as simple as someone picking up the phone and saying so-and-so is a fraud, and the embassy starts denying visas. Her ex must have had significant evidence of something that led them to believe otherwise. Now, I am not saying what he claim is true, I am just saying whatever he did was sufficient enough for an officer to have doubt. There may be something related to her situation that is a big missing piece to the puzzle for you to understand.
