In a visa case, USCIS doesn't care about taxes or domicile.  Taxes and domicile are Dept. of State issues dealt with at the NVC stage.  If not required to file taxes, there is no need to file.  With income in 2019, the OP will file a tax return by tax filing deadline in April 2020.

I have a similar issue, filing for my husband in the UK but as I have been in the UK since I was 13 and now 28, I haven’t never filed taxes.

So should I not file for the previous years and just focus on gaining employment in the US for the I-894?

Or do I need to show taxes for the previous years only at the NVC stage for which I should get together the previous taxes?

also- I’m the i-130 where it asks about employment, will it matter if it states unemployed atm but details of employment previously?

Sincerely,

confused American 🤦🏼‍♀️

Both - You only need to file if you make above the threshold - you can always file even if you are not above.     As for the I-864 itself, you are not going to show a US tax return based on a job for over a year so I would focus on domicile. trying to find a job, and finding a Joint Sponsor unless you guys are going to be able to self sponsor.   Neither of those need to be dealt with prior to filing the I-130.

I take it you are going to file a DCF before the London USCIS Office closes.

just to be clear- this domicile issue is not to be proved at the i130 stage?

Domicile is considered at the Consulate.   This is technically a family reunification visa.
