Hello, we're almost at the NVC document stage. I was just going through the I-864 document again and I'm not sure what to do. We will likely be uploading things next week, however, I only just received my W-2 today. I wasn't planning on submitting my taxes until closer to April. So the timing is a little iffy with the "most recent tax year" tax return. 

I'm planning on submitting 2016, 2017, 2018, and my most recent W-2. Then, since my husband's interview is in Montreal, we're looking at like a 6 month wait for the interview, I can give him the 2019 tax return in case they ask for it. My income definitely isn't a problem. I just want to make sure that this is the right thing to do, since it's still pretty early in the year and taxes aren't due yet. 

 

Also, when it asks for income, should I put my base salary, or on average what I earn with overtime? My base salary alone is more than fine to be his sponsor, but my actual income is on average 150% my base salary with overtime. 

 

Thanks for any suggestions & help! I want to make sure no documents get rejected at this stage as I've heard it can delay everything.

Maybe you can, maybe you can't. With each passing day, more and more people file, and by early April, there is a flood of filings. Each day you delay will take longer to process. If you need official documents from the IRS at a certain time, you may not have them.

I’ll be able to submit our NVC documents early next week. Even if I started my tax returns today, I’m still a few weeks off being ready to submit them. Our interview isn’t likely to happen until after June or so. I’ll have my taxes filed long before that. I just don’t want to delay submitting the NVC documents a few weeks to a month while I do my taxes. Especially since taxes are due until April.
 

We got married this year so I need more time to figure that out since he’s a non-resident alien. 


Maybe someone in the board has experience with this from last year.

He can just take the 2019 tax return to the interview in case it's asked for.  In your income situation, probably best to just state your base salary.  They can see from your past tax return info and again with the 2019 tax return that you make more than your base salary.

Facts are cheap...knowing how to use them is precious...

I can't even file my state returns until later this week since California is missing some forms still, and then I need some time to review everything. But,  I have my I-864 ready to submit now. 

So I'm going to submit my 2018 tax return as my most recent return (because technically it is). I'll include previous year's tax returns as well. I'll also upload my most recent W-2 to show 2019 earnings. I'll add a cover letter stating that at the time of submission, my 2019 returns were not ready to be submitted. However, the beneficiary/applicant will bring the latest tax return with him to the interview. (Since his interview in Montreal is likely to be after April).

This should work, I would imagine? I wouldn't think they could force people to file taxes before they're due.

That should work fine but your State tax return is not included with the I-864.  Only the federal return.

Hello, I am facing a similar situation. I don't want to wait too long for tax transcript before submitting the I864. For Part 6 24a-c did you enter tax year 2016-2018 instead?

I did 2016-2018 as my most recent tax years. I also submitted my 2019 W-2, 6 most recent payslips, and a copy of the 2019 tax return which I had to mail in. I put in the cover letter that if I have my 2019 tax transcript by the time of the interview that my husband will bring that as well. I know we’re good based on my income. Thanks. I am waiting to get my logon to print out 2018 tax transcript. I may upload the explanation letter while uploading evidence online.

Same issue here, we just submitted our I-864. Our approach was to use my 2018 tax transcripts (ordered online), add additional documentation of my 2019 W-2s with a note that we'd bring the full 2019 tax transcripts to the interview.
