Hi,

my fiancé was interviewed today by the consulate,

she went by herself as I was told that my presence wasn’t required (I regret) 

I bought flight for next month to bring her with me 😔, she got a letter saying that she is no eligible for the visa under section 221g 

on the bottom says that she have to send her passport, the letter that was gave to her and other documents (which I’m not sure if is referring to all the support documents to the case) to VAC and schedule another appointment with me!

she told me she got nervous, so that might  be the cause of what happened,

this is the status of my case online 

 

“Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview etc”

They just gave her a letter that says “you have been found Ineligible for a visa under section 221(g) missing information”

 

And saying that she needs to send her passport, that very same letter, and documents of support,

 

also a new appointment with me (fiancé) petitioner

Why did you already book a flight without her having her visa in her passport?

Best advice is to ALWAYS wait until the visa is issued.

All you can do now is send everything they requested and hope that you get another interview date soon.

ROC Timeline

08/16/19: sent I-751 packet to USCIS Lockbox in Dallas

08/19/19: packet received by USCIS

08/21/19: received text message with case number ( Texas Service Center)

08/23/19: check got chashed

08/26/19: received extension letter in the mail

11/14/19: Biometrics appointment

04/28/20: case got transferred to my local field office in Atlanta

05/28/20: New Card Is Being Produced

05/29/20: New Card Got Approved

06/02/20: We Mailed Your New Card

06/03/20: The Post Office Picked Up Your New Card

06/04/20: Card Was Delivered To Me By The Post Office

I was so sure that she was going to got it!

we didn’t missed anything,

she got D-160

Appointments letter

case number letter 

passport

medical exams

police certificate 

birth certificate 

affidavit I-134 with 3 years of tax transcripts, last 4 paystubs 

proof of relationship, photos, receipts from flowers, Money that I sent to her since 2017...

we know since she was born because we are from the same neighborhood 

we haven’t been married,

we are clean, never been arrested!

 

like a said, on the proof side we were more than good I guess,

but the officer that interview her didn’t even bother to ask for all those papers,

she ask a couple of questions and I guess she wasn’t convince or who knows, and practically told her that I need to be on the next interview.

They obviously doubt the relationship and want to have a chat with you.

Well you knew each other a long time ago and presumably have been visiting a lot recently, so I am running out of the obvious reasons.

Lots of people get nervous, would be natural to be nervous.

But I’m confused on something, in the letter says that I have to Drop off at VAC passport, that letter that they gave her and documents of support, my confusion is on the documents of support if they are referring to all the documents, like D-160, proof of relationship etc.

What exactly is checked on the 221G? "Other documents" is too vague unless the Interviewing officer told her what those documents are.

The fact that they are giving a second chance interview is good, but I would seek clarification on what documents they want.

The letter is in Spanish, but it clearly says “you need to drop-off at any MAILBOXES your passport with this letter and any required documents”

but it doesn’t says what documents, it doesn’t mention any besides the letter and passport!

 

also at the end says “we suggest that you and your petitioner attend together to a new interview, to schedule a new appointment go to .....”
