ETSA question with I-130 in process

Hello all,

 

To revive this topic again I would like to understand something.

 

I am currently have a ESTA visa which is valid for 2 years. I applied for this visa in September 2019 however, me and my wife have submitted the I130 petition in November 2019 which is currently pending. As the visa is valid for 2 years, am I allowed to use this still? or do I need to re-apply for the ESTA visa due to submitting the I130 application after? Please advise.

You're 100% allowed to use it. I got my ESTA in Oct 2019, married in USA Oct 2019, went back to home country, applied for i-130 Nov 2019 now back here in the USA visiting for 3 months on ESTA.

ESTA isn’t a visa. It means you got the okay to travel to the US without a visa on the visa waiver program. Continue to use it until you get an actual visa (The IR1/CR1 spouse visa) .
