AOS after marriage on K1 visa

Hi everyone!  I am looking for a basic run down of what I need to do after my fiance and I get married. He is currently here on K1 visa and we are getting marriedin a few weeks. Is it just more paperwork? is there an interview? can we be denied?

The process continues.  It is recommended that marriage and filing for adjustment of status be done within 90 days after arrival.

Read the guide that @missileman linked, but to answer the questions you asked, yes, most likely, and possibly.

 

That being said, the process is not that difficult, and VJ members are here to answer specific questions you may have.

In addition to the AOS process (which you have to go through for your husband to stay here legally) ...

 

If you haven't gone to the local SSA office and had him apply for an SSN, do it now (before you're married; some SSA agents do not understand the regulations around K-1s, so may tell you that after you're married you're not eligible, but if it's less than 76 days -- two weeks short of the 90 days from POE due to your K1 -- he is eligible for one). It may not work (due to local SSA agents not understanding how K-1s work with eligibility for an SSN), and you don't technically need an SSN for anything, but it's really helpful to have one rather than arguing with people that it's not needed for insurance, bank accounts, taxes, and the like.

 

If you currently get health insurance through your employer, then as soon as you have your marriage certificate, contact your employer's HR department about adding him to your health insurance; marriage is a qualifying event that should let you change your benefits. You may want to change some other things too (other kinds of insurance, life insurance beneficiaries, etc.). Not only is this important in case he was sick or injured, it's good to have for AOS evidence.

 

If you're renting the place you live in, you'll probably want to get him added to your lease; it's good documentation both for AOS and for proof of residence if/when he tries to get a driver's license or state ID.

 

You'll also probably want to set up a joint bank account (or make one of your existing accounts joint with him; shows co-mingling finances, which is good documentation for AOS), and add him as an authorized user on one of your credit cards (helps build a credit history, plus gives him some ability to spend money).
